Will of Elijah Jones ~ 1863

  State of North Carolina} In the name of God Amen. Duplin County } I, ELIJAH JONES, being of sound perfect mind and memory, do make, publish and declare, this my last will testament, in manner and form following towit: Item 1st~I commit my body to the dust, my soul to God that giveith. Item 2nd.~ My just debts to pay out of my estate, after they are paid I lend unto my beloved wife ESTHER JONES, All of my property both real and personal during her natural lifetime. Item~ I give and bequeath unto my daughter NANCY JONES one hundred and forty acres of land, to be cut off at the South end of my tract of land, adjoining STEPHEN B. WINDERS' land and others to her and her heirs forever. Item 4 ~ I give and bequeath unto my son JOEL JONES the Balance and residen of my land to him and his heirs forever. Which titles is not to take effect until after the death of my beloved wife EASTHER. (sic) * do not know if some lines are missing rest of page blank? Page 2 bequeath unto my daughter MARY GRIMES my boy George and a girl named Hester, to her and the lawful begotten heirs of her body to them and their heirs forever. Item 6th~ After the death of my wife ESTHER I give and bequeath unto my daughter NANCY JONES one girl named Betsy and child Hannah, to her and her heirs forever. Item 7th~ After the death of my wife ESTHER I give and bequeath unto my son JOEL JONES one boy named Harvey and Rachel and a boy named Isham to him and his heirs forever, also my Coopers tools, Carpenters' Tools, and my farming tools to him and his heirs forever. After the death of my wife, my will and desire is, the stock of 8 ? horses, cattle, hogs and sheep, together with my household and kitchen furniture,be sold an a six monthes credit and my daughter NANCY JONES have one hundred dollars, if any remains after this hundred dollars is paid my desire is that the remainder divided between MARY GRIMES and my son JOEL JONES equally. I hereby nominate and appoint my worthy son, JOEL JONES Executor to this my last will and testament. In witness whereof I have hereunto set my hand and seal this 11th day of August A.D. 1858. JONES Codicil My will and desire is futher that my daughter NANCY JONES to have one bed with its necessary furniture also seventy five dollars for purpose of buying her a horse. My wish and desire is futher that NANCY have my large Bible together with her school books. My will and desire further, that my son JOEL JONES have my young mare Pink one saddle and bridle. One feather bed and its necessary furniture together with his school books. My desire is futher that the remainder of any beds and their furniture be as near equal they be divided after the death of my wife ESTHER, between two daughters and son, to wit: MARY GRIMES, NANCY JONES and JOEL JONES to them and their heirs forever, the remainder all to be sold after the death of my wife ESTHER and the proceeds of the sale, be equally divided between my two daughters and son that I have above named.
