William Mercer To Frederick Smith
Deed for 50 acres lands
This indenture made this eighteenth day of March and in the year of our Lord Christ
one thousand seven hundred and eighty six and in the tenth year of American Independence
between William Mercer of the County of Duplin and State of No. Carolina planter of the one
part and Frederick Smith of the County and State aforesaid planter of the other part.
Witnesseth that I the said William Mercer do for and in consideration of the sum of eight
pounds specie to me in hand paid before the ensealing and delivery of these presents, the
receipt whereof I do hereby acknowledge myself therewith fully satisfied and paid and of every
part and parcel thereof doth hereby exonerate acquit and discharge him the said Frederick Smith
his heirs and executors administrators or assigns forever, and have given granted bargained &
sold and by these presents doth freely & absolutely give grant bargain sell & confirm unto the
said Frederick Smith his heirs and assigns forever, a certain parcel of land containing by
estimation fifty acres, be the same more or less, it lying and being in Duplin County and on
the Et. side of the No. East and on the No. Side of Limestone Creek and on both sides of Cabbin
Branch. Begining at a pine and black jack on the Wt. side of Cabbin branch by a drane or a
gully, thence crossing the swamp runs Et. 140 poles to a pine, thence south to the first large
branch of Cabbin, thence down the said Branch to the main of Cabbin, thence crossing Cabbin and
up a branch called Hog Branch to the giving line, thence to the begining, it being the upper
part of two hundred acres of land patend by me the said William Mercer, and he the said
Frederick Smith his heirs executors admin. or assigns forever to have & to hold the said
bargained land and premises, with all profits & priviledges anisering from the same or in any
wise appertaining, without any interuption of him the said William Mercer his heirs executors
administrators or any other person whatsoever, and furthermore I the said Mercer do for myself
my heirs executors administrators warrent and forever defend the above bargained land and
premises unto Frederick Smith him his heirs executors administrators and assigns forever against
the lawfyll claim of any person whatsoever, but that the said Smith may have and enjoy the same
to his own proper use benefit and behoofe according to the true intent and meaning of these
presents. In witness whereof I the said William mercer have hereunto set my hand and fixed my
seal the day and date above written.
