William Folsom To Phill Southerland
Deed for 300 acres lands
This indenture made this tenth day of December in the year of our Lord one thousand
seven hundred and eighty four & in the eighth year of the American Independence. Between
William Folsom of the County of Burk and State of Georgia of the one part and Phill Southerland
of the County of Duplin and State of North Carolina of the other part. Witness, that the
said William Folsom for divers good causes and considerations him thereunto moving, but more
especially for and inconsideration of the sum of fifty pounds specie to him in hand paid or
secured to be paid before the sealing and delivery hereof, the receipt whereof he doth hereby
acknowledge, and himself therewith to be fully satisfied & contented thereof and therefrom doth
hereby acquit the aforesaid Phill Southerland his heirs executors adms. & assigns, hath
bargained sold enfeoffred conveyed and confirmed & by these presents for himself his heirs
executors administrators hath and doth fully freely and absolutely bargain sell enfeoffe convey
& forever confirm unto the said Phill Southerland his heirs & assigns one certain tract or
percel of land containing by estimation two hundred acres of land be the same more or less
sittuate lying and being in the above said province & County and on the east side of the No.
East of Cape Fear River, on both side of Limestone Creek. Begining at a Birrteh on the South
side of the Creek at Francis Bric e's corner, & runs So. 15 Et. 54 poles to a pine at Samuel
Johnston's line, thence with his line So. 57 Wt. 110 pole to a pine John Atkins's corner, thence
with his line No. 45 Wt. 122 pole to a gum Jeremiah Folsom's corner, thence No. 45 Et. 180
pole to a pine his other corner, thence No. 60 pole to a pine, thence Et. 160 pole to a pine,
thence SO. 90 pole to a gum at the Creek & down the meanders of the Creek to the begining the
said two hundred acres of land being granted tot he aforesaid William Folsom by patent bearing
date September the 26th 1766. To have and to hold the said two hundred acres of land and
premises with the appurtenances unto the said Phill Southerland his heirs & assigns forever,
in as full and ample manner to all entents & purposes as he the said William Folsom did might
or could have held the same before the making hereof, & the said William Folsom doth hereby
engage for himself his heirs exrs. & admn. that at the time of sealing & delivering hereof he
the said William Folsom is and stands seized of the said lands & of an indefeazeble estate of
inheritance in fee simple, and that in himself good right full power and lawfull authority to
grant bargain sell & confirm the said land & premises with the appurtenances unto the said
Phill Southerland his heirs & assigns & that from time to time and at all times forever hereafter
he the said Phill Southerland his heirs & assigns by power and virtue hereof, may & shall enter
unto have hold use occupie & enjoy the said two hundred acres of land and premises free and
clear & freely & clearly acquitted discharged saved kept harmless & indemnified of & from all
former or other gifts grants bargains sails enfeoffments intails jointures dowries executions
entents and incumbrances whatsoever, the quit rents of said land only excepted, moreover the
said William Folsom doth for himself his heirs executors & admn. warrant to defend the title
of the said two hundred acres of land to the said Phill Southerland his heirs or assigns forever,
free from the lawfull claim of him the said William Folsom his heirs and administrators or any
other person or persons whatsoever, and also the said William Foulsom doth covenant and agree
for himself his heirs executors administrators to and with the said Phill Southerland his heirs
or assigns, that at any time hereafter at the reasonably request of him the said Phill Southerland
his heirs or assigns and at his or thier cost and charges in the law, he the said William Folsom
his heirs executors or administrators shall and will make or cause to be made & duly executed any
further or other deed or instrument of writing for the sure making the title of the said land &
premises to him the said Phill Southerland his heirs executors or assigns forever, as he or them
or him or their counsels learned in the law shall advise devise or require. In witness whereof
the said William Folsom hath hereunto set his hand and seal the day and year first above written.
