William Southerland To Abraham Newkirk
Deed for 75 acres lands
State of No. Carolina Duplin County. This indenture made this 14th day of March in
the year of our Lord one thousand seven hundred and eighty five, between William Southerland
of the County & State aforesaid of the one part, and Abraham Newkirk of the same County & State
aforesaid of the other part. Witnesseth that William Southerland for divers good causes and
consideration him thereunto moving, but more especially for and in consideration of the valuable
sum of 500 pounds to him in hand paid or secured to be paid before the sealing & hereof, the
receipt whereof he doth hereby acknowledge and himself therewith to be fully satisfied & content
and thereof and therefrom doth hereby acquit the aforesaid Abraham Newkirk his heirs executors
administrators & assigns, hath bargained sold enfeoffed conveyed & confirmed and doth by these
presents for himself his heirs executors & administrators hath and doth fully freely and absolutely
bargain sell enfeoffe convey and forever confirm unto the said Abraham Newkirk his heirs and
assigns, one certain tract or parcel of land containing by estimation seventy five acres be the
same more or less, situate lying and being in Duplin County on the Et. side of the No. East
River & on the So. side of the Limestone creek. Begining at a Burch on the west side of the
creek at Francis Bryers lower corner and runs So. 15 Et. 54 poles to a pine at Samuel Johnston's
line, thence with his line So. 57 Wt. 110 poles to a pine John Atkins corner, thence with his
line No. 45 Wt. to a stake on the bank of the creek, thence up the various courses of the creek
to the first station, it being part of a tract of land granted to William Folsom by a patent
bearing date September the third 1766 & conveyed from him the said Fullsom to Phill Southerland
and from him to William Southerland & from him to Abraham Newkirk. To have and to hold the said
seventy five acres of land and premises with their appurtenances to the said Abraham Newkirk his
heirs and assigns forever in as full and ample manner to all intents & purposes as he the said
William Southerland did or might have held the same before the making hereof, and the said
William Southerland doth hereby promise for himself his heirs executors & administrators, that
at the time of sealing and delivery hereof, is and stands seized of the said land and premises
of an indefeazable estate of inheritance in fee simple and hath in himself good right and full
power & lawfull authority to grant bargain sell convey & forever confirm the said land and
premises & every part and parcel thereof, with their and every of their appurtenances unto the
said Abraham Newkirk his heirs and assigns and that from time to time and at all times forever
hereafter he the said Abraham Newkirk his heirs and assigns by power and virtue hereof, may and
shall enter into have hold use occupie possess & forever enjoy the said seventy five acres of
land free and clear & freely & clearly acquited discharged saved kept harmless & indemnified of
and from all former or other gifts grants bargains sales enfeoffments wills intails jointures
dowers executions intents incumbrances whatsoever moreover the said William Southerland doth
for himself his heirs ezecutors administrators do promise & engage that at any time hereafter,
at the reasonable request of him the said Abraham Newkirk his heirs & assigns or at his or
their cost & charges in the law, make or cause to be made & duly executed any further deed or
instrument of writing for the same making a title of the said land and premises to him the said
Abraham Newkirk his heirs and assigns forever as he the siad Abraham Newkirk his heirs or
assigns of his be their councisl learned in the law shall advise devise or require & further
more the said William Southerland doth covenant & agree for himself his heirs exers. and
administrators to and with the said Abraham Newkirk his heirs & assigns, to warrant & forever
defend the title of the said seventy five acres of land to him the said Abraham Newkirk his
heirs and assigns, free from the lawfull claime of him the said William Southerland his heirs
Execs. or admins. or any other person whatsoever laying any lawfull clame thereunto. In witness
whereof the said William Southerland hath hereunto set his hand & seal the day and year first
above written.
