William Barns buys from Stephen Williams 13 Jan 1760

(Transcribed by Hunt Sanders) Stephen Williams to William Barns This Indenture made this Thirteenth Day of January in the thirty third year of the Reign of Our Sovereign lord George the second By the grace of God of great Britain, France and Ireland, King Defender of the Faith do Sheweth Greeting Between Stephen Williams Junior of Onslow County and Province of North Carolina Planter of the One Part and William Barns Gentleman of Duplin County and Province of aforesaid. Witnesseth that I the said Stephen Williams Junior Do for and in consideration of the sum of Twenty Pounds proclamation money to me in hand paid before the ensealing of these presents well and truly made to me By William Barns aforesaid the Receipt whereof I do By force and Virtue of these Presents over Page 112. Acknowledge myself therewith and every part And parcel thereof fully satisfied contented and Paid therewith and every part and Parcel thereof do fully freely grant Bargain sell convey and confirm Exonerate and discharge the said William Barns His Heirs Executors administrators and assigns Forever By force and virtue of these Presents as freely fully and absolutely give grant Bargain sell alien convey and confirm unto him the said William Barns his heirs and assigns forever One Certain Tract of land and Plantation Situate lying and Being in a Duplin County and Province of North Carolina on the South side of Burn Coat Swamp Beginning at a white Oak Being a Corner tree Between Benjamin Williams and his brother Stephen Williams and so Running out By aline of marked trees to the Back line to a pine then North 28 West 160 Poles to a pine on Burncoat Swamp thence down the Courses of the swamp to the First Station the dividing line Between Stephen and Benjm Williams Containing By Estimation Ninety acres be the same more or less. Being part of a tract of land that was granted to Anthony Williams containing Six Hundred and forty Acres as by the Patent may appear Bearing Date the Twenty fifth day of September Anno domini 1743 and he the said Anthony gave the aforesaid part of the said tract of land to his son Stephen Williams aforesaid Being the Plantation and Old Mill which formerly Belonged to the said Anthony Williams To have and hold the aforesaid Onbargained and granted premises with all Houses Orchards Barns Nurserys Woods and Woodland grounds timber and timber trees Pastures and Pasture grounds Water and Water Courses with the Title that formerly belonged to my Father Anthony Williams with all other the Priviledges Profits Hereditaments and appurtenances thereunto Belonging or in any wise appertaining to him the said William Barns his Heirs and assigns forever to him and their only proper use benefit and Behoof Forever and that before the ensealing and Delivery of these presents that I the said Stephen Williams am and is the true and lawful owner of the above said Mill and Plantation with all the Priviledges and Appurtenances thereunto Belonging and that I am lawfully seized and Possessed of the same and that I have good Right and lawfull authority to sell the same to the aforesaid William Barns His heirs and assigns forever and further more I covenant I convenant promise and agree to With the said William Barns that I will from time to time Warrant and Defend the aforesaid Bargained and Demised premises from me my heirs Executors administrators and assigns forever from any other person or persons whatsoever laying any lawfull claim Whatsoever Free from all other Rights Bargains Sales mortgages Will gifts or entails whatsoever and all other encumbrances whatsoever that has may or shall come against the said land as aforesaid Except the Quit Rents that from the date of these present become due to the crown By force and Virtue of these presents To Have and to Hold occupy possess and enjoy the aforesaid demised premises premises forever hereafter in lawfull quiet and Peaceable Possession with all the appurtenances thereunto belonging As Witness Whereof I the said Stephen Williams Junior has hereunto set my hand and fixed my seal this the Day and year above Written in the year of Our Lord anno domino One thousand Seven Hundred and Sixty 1760 Signed Sealed and Delivered in the } Presence of James Howard } his } Lawrence X Hall } Stephen Williams Junior {Seal } mark } his Moses Cox & John X Williams Mark The Within deed From Stephen Williams to William Barns containing Ninety acres of land was proven in Open Court by the Oath of John Williams and ordered to be Registered.
