(Transcribed by Joan S Dunn) Deed Book 1 A Page 128, & 129 Timothy Murphy To James Pearsall Deed for 300 acres lands This indenture made this seventeenth day of January in the year of our Lord one thousand seven hundred & eighty five in the ninth year of American Independence, between Timothy Murphy of the one part, and James Pearsall Esqr. of the other part both of the State of North Carolina & County of Duplin. Witnesseth, whereas by patent bearing date the fourth day of December one thousand seven hundred & forty four two hundred acres of land was granted to Timothy Murphy and bounded as follows Viz. on the west side of the North East branch of Cape Fear river near Elder Branch Viz. begining at a large white oak near the head of Stocking head branch thence runing So. 50 Et. 40 chains one hundred & sixty poles to a large pine, thence No. 40 Et. fifty chains to a water oak in Caney branch swamp thence up said swamp No. 50 Wt. 40 chains to a pine, thence No. 40 Wt. 50 chains to the first station, and whereas by indenture bearing date the third day of January in the year of our Lord one thousand seven hundred and sisty four by deed duely executed William Laycock then of the said County & State duely sold & conveyed unto the said Timothy Murphy one other tract of land containing one hundred acres being part of a tract containing two hundred acres granted by pattent to Jacob & Henry Wells of the said County, between John Miller's land on Stocking head branch & Timpthy Murphy's own line. Beg'g at a large pine, thence runing along the patent line So. 68 Wt. forty two chains to a stake in John Miller's line, thence along his line seventeen chains to a stake by said branch, thence up the branch to Timothy Murphy's line & along his line So. 47 degrees Wt. twenty nine chains to the first station. Now this indenture witnesseth that I the said Timothy Murphy for and in consideration of the sum of one hundred pounds current money of the State aforesaid to him in hand paid by the said James Pearsall, the receipt whereof I the said Timothy Murphy doth hereby acknowledge have granted bargained sold & by these presents do grant bargain & sell unto him the said James Pearsall his heirs & assigns th afore mentioned two pieces or parcels of land with their appurtenances & every part & parcel thereof to his & their only proper use benefit & behoof forever against me the said Timothy Murphy my heirs & executors or administrators & assigns & agains all and every other person or persons whatsoever from by or under me & I the said Timothy Murphy for myself my heirs executors and administrators & assigns do covenant promise & grant to and with the said James Pearsall his executors administrators & assigns that he the said James Pearsall shall & may from time to time & at all times have hold occupy & enjoy peacebly & quietly the above discribed two tract or pieces of land free & clear of all & manner of incumbrances whatsoever, and by these presents I the said Timothy Murphy for myself my heirs executors administrators & assigns, warrent secure & defend the aforesaid James Pearsall his executors administrators & assigns. In witness whereof I the said Timothy Murphy have hereunto set my hand & seal the day & year first above written. Timothy Murphy Signed sealed & delivered in the presence of us James Lockhart Daniel Teachy Charles Miller State of No. Carolina, Duplin County, January Court 1785.
