Thomas Phips To Lewis Thomas Deed 13 March 1784

(Transcribed by Joan S Dunn) Deed Book 1 A Page 48, 49 & 50 Thomas Phips To Lewis Thomas Deed of 50 acres lands This indenture made the thirteenth day of March in the year of ouf Lord one thousand seven hundred and eighty four and in the eighth year of the Amarican Independency, between Thomas Phips of Duplin County and State of North Carolina planter of the one part and Lewis Thomas of the said County and State aforesaid planter of the other part. Witnesseth that the said Thomas Phips for and in consideration of the sum of ten pounds lawful money to him in hand paid at the ensealing and delivery of these presents the receipt whereof is hereby acknowledged and the said Thomas Phips he the said Lewis Thomas doth exonerate and discharge and hath bargained granted and sold and by these presents doth fully and absolutely grant, bargain, sell, alien, convey and confirm unto him the said Lewis Thomas his heirs and assigns forever a certain tract of parcel of land lying and being in Duplin County butted and bounded as follows. Viz. Begining at a sweet gum in Wahunga Swamp and runing S. S. Et. along a line of marked trees agreed upon between the said Thomas Phips and Lewis Thomas to a Bay tree about the midle of a pond a fore & after free in the side Thomas Phips's line, thence No. 70 Et. to a whate oak & pine, thence to Wahunga Swamp along the said line, thence up the run of the swamp to the begining, containing fifty acres of land, be the same more or less, being part of a tract of two hundred acres of land held by a deed granted to the said Thomas Phips by Governer Martin, bearing date the forth day of March one thousand seven hundred and seventy four, together with all houses and buildings thereon contained. To have and to hold the said land and all and singular the appertenances profits and herititants with all woods and all priviliges belonging unto him the said Lewis Thomas his heirs executors administrators & assigns forever, and the said Thomas Phips doth for himself his heirs executors administrators and assigns covenant, promise, grant & agree to & with the said Lewis Thomas his heirs and assigns that he the said THomas Phips at the time of ensealing and delivering hereof is the true sole and lawful owner of the said land and premises and hiath in himself good right full power and lawful authority to grant bargain and sell the same in manner aforesaid & that the said Lewis Thomas his heirs executors administrators and assigns & every of them shall & may from time to time at all time hereafter peacably and quietly have hold use occupy possess and enjoy the said land and premises with the appertenances with out any let snit troulbe disturbance or interrption of him the said Thomas Phips his heirs executors administrators or assighs or any of them or any other person or persons claiming from by or under him or them or any of them and that the said tract or parcel of land at the day hereof is & so shall remain forever continue and be unto him the said Lewis Thomas his heirs and assigns forever free and freely acquited exonerated & discharged of and from all manner of former and their gifts grants bargains, sales, leases, wills, intails, jointures rents and exchanges of rents quit rents, widows, dowers and all other incumbrance whatsoever and the said Thomas Phips for himself his heirs executors & administrators doth covenant, promise, grant and agree to and with the said Lewis Thomas in manner and form following. Viz. that he the said Thomas Phips and his heirs shall and will at the request of and at the proper cost & charges of him the said Lewis Thomas at any time or time when thereunto demanded make acknowledge perform and execute or cause of suffer to be mane acknowledged performed and executed all and every such act and acts deed and deeds which the said Lewis Thomas his heirs executors administrators or assigns of his or their council casued in the law shall be advised or required better and further assuming & sure making & establishing the said land unto the said Lewis Thomas his heirs executors administrators & assigns forever. In witness whereof the said Thomas Phips hath hereunto set his hand & seal the day & year of our Lord above written. Thomas Phips Signed sealed & delivered in the presence of us Felix Frederick Jonathan Thomas State of No. Carolina, Duplin County, July Court 1784.
