Thomas Phipps To Felix Frederick
This indenture made this sixteenth day of October in the year of our Lord
one thousand seven hundred & eighty seven & in the eleventh year of our Independency,
Between Thomas Phipps of Duplin County & State of No. Carolina planter of the one
part & Felix Frederick of the same County & State aforesaid, taylor, of the other
part witnesseth that the said Thomas Phipps for and in consideration of the sum of
twelve pounds lawfull money to him in hand paid at the ensealing & delivering of
these presents, the receipt whereof is hereby acknowledged & the said Thomas Phipps
he the said Felix Frederick doth exonerate acquit and discharge & hath bargained
granted & sold & by these presents doth fully & absolutely grant bargain sell alienth
convey & confirm unto him the said Frederick his heirs & assigns forever, two certain
tracts or parcels of land (to wit) the first lying & being in Duplin County butted &
bounded as follows Viz. Begining at a small white oak in the edge of a pond, & runs
thence So. 70 Wt. 180 poles to a pine, thence So. 20 Et. 180 poles to a pine, thence
No. 70 Et. to a bay tree in the middle of a pond, a for & aft tree, in the said Thomas
Phipps ;ome. thence along a line of marked trees to a sweet gum in Nahunga Swamp it
being the dividing line between Thomas Phipps & Lewis Thomas, thence down the run of
the swamp or as Sutton Bird's line runs on the north side of the swamp to Thomas Phipps
line, thence along said Phipps'es line to the begining it being part of the two hundred
acres of loand held by the said Thomas Phipps by patent granted by Governor Martin date
the fifty day of March 1774, containing in the whole one hundred & frifty acres of land
be the same more or less, also the other tract or parcel of land situate lying & being
in Duplin County on the No. side of Nahunga swamp, adjoining the above mentioned tract
including William Moor's pocoson. Begining at a pine the said Phipps corner & runs
along his line No. 75 ET. 180 poles to a white oak his corner by a pond, thence Et. 17
poles to a small pine his corner, thence the same course No. 70 poles to a pine, thence
Wt. 154 poles to a red oak on William Moor's line, So. 11 Wt. 54 poles to a pine, thence
So. 43 poles to a pine William Elliot's corner, thence along his line So. to the begining,
containing two hundred acres of land as more fully doth appear by patent granted by
Governor Caswell bearing date the first day of September 1785, in the tenth year of our
Independence, together with all houses buildings thereon contained. To have and to hold
the said lands & all and singular the appurtenances profits & hereditaments with all woods
& previledges belonging unto him the said Felix Frederick his heirs executors administrators
& assigns forever & the said Thimas Phips doth for himself his heirs executors administrators
& assigns covent promise grant and agree to and with the said Felix Frederick his heirs &
assigns that he the said Thomas Phips at the time of ensealing & delivering hereof is the
true sole & lawful owner of the said two tracts or parcels of land & premises & hath in
himself good right full power and lawfull authority to grant bargain & sell the same in
manner aforesaid, & that the said Felix Frederick his heirs executors administrators &
assigns & every of them shall & may from time to time & at all times hereafter peacebly
& quietly have hold use occupy possess & enjoy the said lands & premises with the
appurtenanes, without any let suit trouble disturbance or interuption of him the said
Thomas Phips his heirs executors adms. or assigns or any of them or any other person or
persons claiming from by or under him or them or any of them, and that tracts or parcels
of land at the day hereof is & do shall remain forever continue & be unto him the said Felix
Frederick his heirs & assigns forever free & freely acquited exonerate & discharge of and
from all manner of former and other gifts grants bargains sales leases wills entails jointures
rents and arrearages of rents quit rents widows dowers and all other incumbrances whatsoever
& the said Thomas Phips for himself his heirs executors & administrators doth covenant
promise & agree to & with the said Felix Frederick in manner and form following Viz.
that he the said Thomas Phips & his heirs shall and will and the request of and at the
proper cost, and charges of him the said Felix Frederick & at any time when thereunto
demanded, make acknowledge perform and execute, or cause or suffer to be made & acknowledged
performed & executed all & every such act & acts deed or deeds, which the said Felix Frederick
his heirs executors administrators or assigns or his or their Councel learned in the law shall
be advised or required for the better & further assuring & sure making & establishing the said
lands unto him the said Felix Frederick his heirs executors administrators & assigns forever.
In witness whereof the said Thomas Phips hath hereunto set his hand & seal the day & year of
our Lord above written.
