(Transcribed by Joan S Dunn) Deed Book E Page 354 & 355 Thomas Phipps To Fredrick Felix Deed 320 acres This Indenture made this Eighteenth day of October one thousand seven hundred and Ninety one and in the Sixteenth year of American Independence- Between Thomas Phips Senior of Duplin County and State of North Carolina and Felix Fredrick of the other part of foresaid County and State. Witnesseth that the said Thomas Phips for and in Consideration of the Just and full sum of Ten pounds good and Lawfull Money to him in hand paid the Receipt whereof he doth hereby acknowledge. Hath granted Bargained sold aliened Released and Confirmed and by these presents for himself and his heirs doth grant bargain sell alien Release and forever confirm unto the said Felix Fredrick his heirn and assigns- A certain Tract or parcel of land situate Lying and being in County aforesaid on both sides of the Main Branch of Mahunga being a part of a Survey of William Eliots- Beginning at a white oake by the side of a Branch at the Line that was Thomas Phips’s line then but now Felix Fredricks Line and runs No. 116 pole to a small pine thence Wt. 115 pole to James Reardons Beginning and thence 340 pole a straight course to the East line of William Eliots Survey and thence with said East line to a pine by a Pocoson thence No. 52 pole to a pine on the line that was formerly Phips but now Fredrics thence So. 70. Wt. 64. Pole to a pine his corner thence along his line to the beginning so as to Contain three hundred and twenty acres of Land or the one half of said Eliots Survey and no more be the same more or Less- With all woods waters or water Courses with all profits or Commodities advantages and appurtainances whatsoever to the same belonging or in any wise appertaining thereunto and every part or parcel thereof. To have and to hold the said Land as above Mentioned with every appurtainance theres of unto the said Felix Fredrick his heirs or assigns and to his and their heirs or assigns forever and he the said Thomas Phips for himself his heirs Doth Covenant Grant and agree to and with the said Felix Fredrick his heirs and assigns that he and they shall and may at all times hereafter Peaceably and Lawfully hold and enjoy the said Granted Land and premises free and Clear from all forms sails Gifts grants Mortgages Right of Dowery or any other encumbrance whatsoever and he the said Thomas Phips and his heirs shall will and truly and forever warrant and Defend the said Land and premises with all and every of the appurtainances thereunto belonging unto the said Felix Fredrick his heirs ad assigns agains all and every other person or persons whatsoever. In witness whereof the said Thomas Phips hath hereunto set his hand and seal the day and Date above Written Signed sealed and Delivered Thomas Phips In presence of us David Middleton Richard Cooper State of No. Carolina October Term 1791 Duplin County Then was the within Deed proved in open Court by the Oath of Richard Cooper and ordered to be Registered.
