Thomas Johnston To Benjamin Johnston
Deed for 200 acres lands
This indenture made the 12th day of June in the year of our Lord one thousand
seven hundred & seventy five. Between Thomas Johnston of the province of No. Carolina
& County of Duplin of the one part, & Benjm. Johnston of the same province & County
aforeaid planter, of the other part. Witnesseth, that the said Thomas Johnston for and
in consideration of the sum of forty pounds proclamation money paid to him in hand well
& truly by the said Benjamin Johnston the receipt whereof he doth acknowledge, & himself
discharge the said Benjamin Johnston his heirs executors & administrators forever, hath
granted bargained sold aliened enfeoffed conveyed & confirmed unto the said Benjamin
Johnston his heirs & assigns forever, & doth by these presents fully freely and absolutely
grant bargain sell alien enfeoffe confirm unto the said Benjamin Johnston his heirs and
assigns forever, one certain tract or parcel of land situate lying & being in Duplin
County & Province aforesaid on Stewarts Creek branch of Black River. Begining at a pine
in Felix Kenan's line, thence runing along the same No. 15 Et. 5 chain 75 links to a white
oak thence No. 50 Et. 4 chains to a stake No. 5 Et. 25 chains to a bay by Stewarts Creek,
thence up the Creek nine chains to a small elm by the Creek side by Mr. McCulloch's line,
thence along said line No. 86 Et. 25 chains to a pine, So. 60 Et. 42 chains to a pine So.
9 Wt. 18 chains to a stake, & thence to the first station, containing by estimation two
hundred acres be the same more or less. To have and to hold to him the said Benjamin
Johnston his heirs and assigns forever, the said granted and bargained premises, togeather
with ways waters & water courses mines minerals hereditaments & appurtenances thereunto
belonging or in any wise appertaining, & I the said Thomas Johnston for myself my heirs
executors & administrators do covenant promise grant and agree to and with the said Benjamin
Johnston his heirs and assigns, in manner & form following, that is to say, at any time or
times before the ensealing & delivery hereof, I am the true sole & lawfull owner of all the
above bargained & granted premises & am lawfully seized & possessed of the same in my own
proper right as a good perfect & absolute estate of inheritance and lawfull authority to
sell and dispose of the same in manner and form aforesaid, & the said Benjamin Johnston
his heir & assigns shall and may from time to time & at all times forever hereafter, by
force & virtue of these presents, lawfully peacibly & quietly have hold use occupie possess
& enjoy all and singular the within granted and bargained premises with the appurtenances
thereof free & clear and freely & clearly acquited exonerated & discharged of from all &
all manner of former gifts grants bargains sales leases mortgages wills joyntures dowers
judgments executions & entents & all manner of incumbrance whatsoever had made committed
done or suffered to be done by me my heirs executors administrators or any of us at any
time or times before the ensealing & delivery hereof, & furthermore I the said Thomas
Johnston doth for myself my heirs executors & administrators covenant and engage all the
within granted & bargained premises with the appurtenances thereof unto the said Benjamin
Johnston & his heirs forever, his Majestys & his successors yearly quit rents of four
shillings proclamation money for each hundred acres which annually shall become due from
the date hereof (only excepted) & will forever hereafter by force & virtue of these presents,
warrant secure and defend the same unto him the said Benjamin Johnston his heirs & assigns
forever, hereafter from the lawful claim or claims of any person or persons whatsoever
claiming or to claim by from or under me my heirs or assigns. In witness whereof I the
said Thomas Johnston hath hereunto set my hand and fixed my seal the day & year first before
written.
