Thomas J. Kinnear Late Sheriff To John A Kornegay Deed 18 April 1839

(Transcribed by Joan S Dunn) Deed Book 12 Page 12, 13, & 14 Thomas J. Kinnear Late Sheriff To John A Kornegay for house & Lot Thins Indenture made this the 18th day of April AD 1839 between Thomas J. Kinnear late Sheriff of Duplin County of the one part and John A Kornegay of the second part Witnesseth that whereas a writ of feire facios in favour of Parkins Hopkins and White for the sum of one Thousand dollars with interest and costs issued from the office of the Clerk of the Court of Pleas and Quarter Session for the County of Duplin tested of the April Session Apr 1838 of the said Court and was placed in the hands of the said Thomas J. Kinnear their Sheriff of said County Who by verture of his said office of Sheriff did levey the lands one the following Lot or parcil of ground to wit a Lot being in the town of Kenansvill Known as Lot No 5 in the south East Quarter of said town Regining on cross Street and runing with said street South 75 East 105 feet thence South 15 Wt 75 feet thence North 75 Wt 105 feet thence North 15 East 75 feet to the first station and where as the said Thomas J. Kinnear Sheriff as aforesaid did return the said writ of fiene facies no sale for want of a bider to the July Session of the said Court and where as also a writ of venditione expones duly Issued from the said office tested of the said Cost named Session of the said court and was delivered to the said Thomas J. Kinnear Sheriff as aforesaid commanding him to expose to sale the above described Lot of ground to Satisfy the said Parkins Hopkins and White the said sum of one thousand Dollard with Intrust and cost as aforeaid the said writ reciting the aforesaid buy by verture of the aforesaid writ of fine facias and the afore said return then by the said Kinnear Sheriff as aforesaid and whereas the said Thomas J. Kinnear by venture of his office of Sheriff after due advertisment accorden to have for the space of forty days at the Courthouse door in Kenansville and other public place did on the seventeenth day of October AD 1838 by venture of his office of Sheriff as aforesaid and under the authority of the said write of venditions expones expose the said Lot of ground herein before describe to publick sale to the highest bider at the Courthouse door in Kenansvill Duplin County when and where the said John A Kornegay become the last and highis bider at the sum of three hundred dollars and fifty cents Now the said Thomas J. Kinnear late Sheriff of said County of Duplin for and inconsideration of the sum of three hundred dollars and fifty ets to him in hand paid by the said John A Kornegay at and before the ensealing and delivery of these presents the receipt whereof he doth hereby Acknowledge hath given granted bargain sale aliened enfeoffed and confirm and by these presents doth give grant bargain sell alien enfeoffed and confirm unto the said John A Kornegay the above describe Lot and parcil of ground situate in the town of Kenansvill and bounded as herein before discribed To have and to hold the same with all and singular the appertenances thereunto belonging or in any wise appertaining unto him the said John A Kornegay his heirs and assigns forever and the said thomas J. Kinnear the said Lot of ground and premises for him self his heirs & executors and administrators by vertue of his said late office of Sheriff unto the said John A Kornegay his heris executors and administrators shall and will and by these presents doth for ever warrant and defend against the lawful claim or claims of him the said Thomas J. Kinnear his heirs and assigns and against the lawful claim or claims of all persons whatsoever so far as by ventue of his office of Sheriff as aforesaid he is autherised bound or empowered to do and no futher In witness whereof he hase hereunto set his hand and seal the date first above writen Th J Kinnear Signed sealed and delivered in presents of witness H Sullivan State of North Carolina Duplin County Court of Pleas and Quarter Session July Term 1839 the execution of the within deed is duly acknowledge in open Court by Thomas J Kinnear Late Sheriff and is ordered to be registered Copy E M Routledge for N Routledge Regr Test James Dickson Clk
