(Transcribed by Joan S Dunn) Deed Book 1 A Page 369, 370, & 371 Thomas Clarke To Shadrack Stallings Deed for 320 acres lands This indenture made this twenty fourth day of February in the year of our Lord one thousand seven hundred and eighty seven & in the eleventh year of Independency. Between Thomas Clarke of the County of Brunswick and State of No. Carolina of the one part and Shadrack Stallings of the same State & County of Duplin of the other part. Witnesseth that he the said Thomas Clarke for divers good causes and consideration but more especially for and in consideration of the sum of three hundred pounds specie to him in hand paid or secured to be paid before sealing & delivery hereof the receipt whereof he doth acknowledge and himself therewith to be fully satisfied & contented & thereof and therefrom doth hereby acquit the said Shadrack Stallings his heirs executors administrators & assigns hath bargained sold enfeoffed conveyed and confirmed & hath by these presents for himself his heirs executors administrators hath doth fully freely and absolutely bargain sell enfeoffe convey & forever confirm unto the said Shadrack Stallings his heirs & assigns one certain tract or parcel of land containing three hundred and twenty acres lying and being in the County of Duplin on a Branch of Rockfish Creek know by the name or Knowls'es or James's Creek. Begining at a red oak marked I P, runing thence So. 30 Et. 14 chains thence So. 60 Wt. 57 chains to a red oak, thence No. 30 Wt. 57 chains to a stake, thence No. 60 Et. 57 chains, thence So. 30 Et. 43 chains to the first station. To have and to hold the said three hundred and twenty acres of land and premises with the appurtenances unto the said Shadrack Stallings his heirs and assigns forever, in as full and ample manner to all intents and purposes as he the said Thomas Clarke did might or could have held the same before the making hereof and the said Thos. Clarke doth hereby promise and engage for himself his heirs executors and administrators that at the time of sealing & delivery hereof the said Thomas Clarke is & stands seized of the said land & premises of and indefeazable estate of inheritance in fee simple and hath in himself good & rightfull power & lawfull authority to grant bargain sell convey & forever confirm the said land and premises and every part and parcel thereof with their appurtenances unto the said Shadrack Stalling his heirs & assigns, and that grom time to time and at all times forever hereafter the said Shadrack Stallings his heirs and assigns by power and virtue hereof, may and shall enter unto have hold use possess and forever enjoy the said three hundred & twenty acres of land, free and clear and freely and clearly acquited discharged saved kept harmless & indemnified off and from all former or other gifts grants bargains sails wills intails jointures dowries executions entents or incumbrances whatsoever the taxes which shall hereafter become due only excepted, moreover the said Thomas Clark doth for himself his heirs executors & admns. do promise and engage that at any time at the reasonable request of him the said Shadrack Stallings his heirs or assigns, or at his or their cost and charges in the law make or cause to be made & duly executed any further or other deed or instrument of writing for the sure making a little of the said land and premises to him the said Shadrack Stalling his heirs & assigns forever, as he the said Shadrack Stallings his heirs & assigns or his or their councils learned in the law, shall advise devize of require, & for the more the said Thomas Clark doth hereby covenant and agree for himself his heirs executors & administrators to and with the said Shadrack Stallings his heirs & assigns to warrant and forever defend the title of the said three hundred and twenty acres of land to him the said Shadrack Stalling his heirs and assigns, free from the lawfull claim of him the said Thomas Clark his heirs executors or administrators, or any other person or persons whatsoever. In witness whereof the said Thomas Clark hath hereunto set his hand & seal the day & year above written. Thomas Clarke Signed sealed & delivered in the presence of John Howell John Holdon State of No. Carolina Duplin County April Term 1787.
