Thomas Clarke To Shadrack Stallings
Deed for 50 acres lands
This indenture made this twenty fourth day of February in the year of our Lord one
thousand seven hundred & eighty seven, & in the eleventh year of Independency. Between
Thomas Clarke of the County of Brunswick & State of North Carolina of the one part & Shadrack
Stallings of the same State & County of Duplin of the other part. Witnesseth that the said
Thos. Clark for divers good causes & consideration, but mor especially for and in
consideration of the sum of forty pounds specie to him in hand paid or secured to be paid
before the ensealing and delivery hereof, the receipt whereof he doth hereby acknowledge &
himself therewith to be fully satisfied & content & therewith & therefrom doth hereby acquit
the said Shadrack Stallings his heirs exrs. admns. & assigns, hath bargained sold enfeoffed
conveyed & confirmed & hath by these presents for himself his heirs executors admns. hath
doth fully freely & absolutely bargain sell enfeoffe convey & forever confirm unto the said
Shadrack Stallings his heirs and assigns, one certain tract or parcel of land, containing by
estimation fifty acres lying & being in the County of Duplin, between Evan Jones's & Thomas
Clark's land on a Branch of Rockfish Creek. Begining at a maple in the swamp below a corner
of said Mr. Clark's, thence runing No. 60 Et. 23 chains 37 links to a white oak, thence So.
30 Et. 23 chains 37 links to a hickory, thence So. 60 Wt. 20 chains to a stake in Evan Jones's
line, then down his said line four chains to a stake in said line, thence to the first station.
To have and to hold the said fifty acres of land & premises with the apurtenances unto the
said Shadrack Stallings his heirs and assigns forever, in as full and ample manner to all
intents & purposes as he the said Thomas Clark did could or might have held the same before
the making hereof, & the said Thomas Clark doth hereby promise & engage for himself his heirs
executors & administrators, that at the time of sealing & delivery hereof, the said Thomas
Clark is & stands seized of the said land & premises of an indefeazable estate of inheritance
in fee simple & hath in himself good & rightfull power and lawfull authority to give grant
bargain sell convey & forever confirm the said land and premises & every part & parcel thereof
with their appurtenances unto the said Shadrack Stallings his heirs and assigns, and that from
time to time & at all times forever hereafter, the said Shadrack Stallings his heirs and
assigns by power and virtue hereof may and shall enter into have hold use posses & forever
enjoy the said fifty acres of land free & clear and freely and clearly acquited discharged
saved kept harmless & indemnified of and from all other rights gifts grants bargains sails
emfeoffements wills intales jointures dowries executions entents or incumbrances whatsoever,
the taxes which shall hereafter become due only excepted, moreover the said Thomas Clark
doth for himself his heirs executors & admns. do promise and engage that at any time at the
reasonable request of him the said Shadrack Stallings his heirs or assigns, or at his or
their cost & charges in the law make or cause to be made and duly executed any further or
other deed or instrument or writing for the sure making a title of the said land and premises
to him the said Shadrack Stallings his heirs & assigns forever, as he the said Shadrack
Stallings his heirs & assigns or his or their council learned in the law shall advise devise
or require & furthermore the said Thomas Clark doth hereby covenant & agree for himself his
heirs executors & administrators to & with the said Shadrack Stallings his heirs & assigns to
warrant & forever defend the title of the said fifty acres of land to him the said Shadrack
Stallings his heirs & assigns, free from the lawfull clame of him the said Thomas Clark his
heirs executors or admns. or any other person or persons whatsoever. In witness whereof the
said Thomas Clark hath hereunto set his hand & seal the day & year above written.
