(Transcribed by Joan S Dunn) Deed Book 1 A Page 263, & 264 Thomas Burton To James Evans Deed for 400 acres lands State of No. Carolina this indenture made the seventh day of June in the year of our Lord one thousnad seven hundred and seventy nine, and int he third year of American Independence, between Thomas Burton of the province aforesaid and County of Duplin, Planter, of the one part and James Evans of the same province and County aforesaid planter, of the other part. Witnesseth, that the said Thomas Burton for and in consideration of the sum of one hundred pounds lawfull money of the State to him in hand paid before the insealing and delivery of these presents, by the said James Evans, the rect. whereof he doth hereby acknowledge and himself therewith to be fully satisfied contented and paid and of every part and parcel thereof hath given granted bargained sold aliened enfeoffed conveyed confirmed assigned and sett over unto the said James Evans and by these presents doth fully freely and absolutely give grant bargain sell alien enfeoffe convey confirm assign and sett over unto the said James Evans his heirs & assigns forever, all that tract or parcel of land situate lying & being in the province and County aforesaid, on the west side of the No. East Branch of Cape Fear River. Begining at a pine standing in the woods on the north side of persimmon Branch near a small branch running into persommon near the mouth, runing SO. 12 Wt. 80 pole to a pine So. 55 Et. 160 pole to a poplar, No. 25 Et. 40 pole to a pine in Condrick Whitman's line, thence along the said line No. 42 Wt. 100 pole to a pine, thence No. 18 Et. 240 pole to a Branch called Boney's Branch, thence as up said Branch So. 72 Wt. 32 pole, So. 18 Et. 160 pole to a pine, So. 88 Et. 160 pole to the first station (Surveyed for William Burton). To have and to hold the said bargained land & premises with the appertenances thereunto belonging to him the said James Evans his heirs and assigns forever, in as full and ample manner as he the said Thomas Burton by his deed could or might enjoy without the least let hindrance molestation or interruption of him the said Thomas Burton his heirs or assigns, and that free and clear and freely and clearly acquited of and from all and all manner of former or other gifts grants bargains sails leases wills mortgages intails jointors judgements dowers executions entents and troubles of any kind whatsoever had made done or committed by him the said Thomas Burton his heirs or assigns, except the publick dues that may lawfully be demanded, and the said Thomas Burton doth hereby further covenant and engage to warrent and defend the said James Evans his heirs and assigns in the quiet & peaceble possession of the said bargained land and premises aforesaid from and against the lawfull claims and demands of any person or persons whatsoever claiming of to clame by from or under him the said Thomas Burston his heirs or assigns forever. In witness whereof the said Thomas Burton hath hereunto set his hand and fixed his seal the day and year first above written. Thomas Burton Signed Sealed & delivered in presence of us Charles Burton John Burton State of North Carolina Duplin County April Term 1786.
