Tho J Kinnear Shff To Nicaner James
Deed for Two tracts of land 129 acres
This Indenture made this 22nd day of October AD 1839 between Thos J Kinnear former high
Sheriff for Duplin County in the State of North Carolina of the one part and Nicann James
of the same state & County of the other part witnesseth that whereas by virtue of a writ
of venditiori Exponas Issued from the Superior Court of Law for Duplin County aforesaid
Tested the fourt monday in September AD 1837 returnable to March term 1838 of said Court
in favour of William Pickett Senr against Cray Padget Sabry Padget Catharine M Padget Spice
Padget Nelson Padget Elizabeth Padget Benjamin Padget & Nancy A Padget Heirs of Benjamin
Padget decd and to the said Thomas J Kinnear Sheriff as aforesaid directed & delivered
commanding him to Expose to sale the lands and tenements of said Heirs lying on the East side
of the North East River below Chinquepin adjoinint the Lands of Jacob Johnston & others also
one piece of land on or near Muddy Creek adjoining the lands Pearsall Lanier Edward Hunter
& others which lands are herein after more particularly descirbed He the said Thomas J Kinnear
after giving due Notice there of by public advertisment did on the 19th day of March 1838
expose to sale at public Auction the lands aforesaid at the Court House in Kenansville to
satisfy the said Writ Deby $18.50 & interest Cost $ 39.10 & as will more fully appear by
refference thereto at which time & place Thomas Burton became the last and highest bidder in
the sum of seventy four dollars and transfered his bid to said Nicaner James Now therefore
this Indenture witnesseth that the said Thomas J Kinnear Sheriff as aforesaid for and in
consideration of the puruins and of the said sum of seventy four Dollars to him paid the
receipt and payment whereof is hereby acknowledged hath granted bargained sold aliened and
confirmed and by these presents doth grant bargain sell alien enfeoff and confirm unto the
said Nicaner James and His Heirs the aforesaid lands and premises one tract begining at a
sweet gum at the head of a bottom thence North 73 Et 18 poles to a pine thence south 75 Et
69 poles to a Lightwood Stump thence South 9 west 22 poles to a stake thence Et 45 poles to
a Light wood Stump Thence South 73 Et 136 poles to a maple thence South 73 Wt 150 poles to a
pine at the Head of Bushes Branch thence down with the run of said Branch to a Holly at the
fork thence up with the other prong & Bottom to the Begining containing one hundred and nine
acres more or Less also one other tract begining at a small gum in a small Branch thence south
44 wt 44 poles to a stake thence so 82 Et 46 poles to a stake on the Hugh Hunters line thence
with his line No 73 Et 12 poles to a stake thence North 4 Et 50 poles to a stake thence No 73
wt 35 poles to a large pine thence to the begining containing twenty acres more or less to
Have & to Hold the aforesaid Lands & premises with the appurtenances unto the said Nicaner
James His Heirs and Assigns to their only proper use & behoof forever and he the said Thomas
J Kinnear Sheriff as aforesaid for himself & his Heirs the aforesaid lands and premises unto
the said Nicaner James & His Heirs against himself & his Heirs and all persons whatsoever so
far as he is authorised by virtue of his office & the Law doth shall & will warrant & forever
defend by these presents In Testimony whereof he the said Thomas J Kinnear Shff as aforesaid
hath hereunto set his hand & seal the day & year first above written signed sealed and delivered
in presence of Patrick Murphy
