(Transcribed by Joan S Dunn) Deed Book 1 A Page 75, 76, & 77 Theophilus Williams Sheriff To John Sullivan Deed for 200 acres of lands This indenture made the nineteenth day of November in the seventh year of the American Independance, and in the year of our Lord one thousand seven hundred and eighty two, between Theophilus Williams, Esqr. high Sheriff of the County of Duplin in the Stae of No. Carolina of the one part and John Sullivan junr. of the same place of the other part. Whereas by a writ of Fien Gacia issued fron the County Court of Duplin in the following words, to wit. State of No. Carolina, to the Sheriff of Duplin County, greeting you are hereby commanded that of the goodsa and chattels lands and tenements of William Hines if to be found in your Bailywick you cause to be made the sum of twenty nine thousand six hundred pounds current money of which John Suliven lately in the county Court of Pleas and Quarter Sessions Duplin recovered against the said William Hines for debt and also the sum of three pounds twelve shillings and seven pence specie as for the cost and charges in the said suit expended, whereof the said William Hines is convicted and liable as appears to us of record & have the said moneys before the justics of the said County Court of Duplin on the thirs Mondy of July next, then and there to satisifie and pay the said John Sulliven his dmages costs & charges aforesaid together with you own fees for this service, herein fail not & have you then and there this writ. Witnesseth William Dickson Clerk of the said Court of Duplin, the eighteenth day of April in the sixth year of the American Independance Anno Domini 1782, by virtue of which said writ the said Sheriff did enter upon and take possession of a certain tract of land sittuate lying and beign in the County of Duplin oforesaid in the fork of the No. East & Goshen and on the head of a branch called Ned's Branch, containing by estimation two hundred acres of land. Begining at a pine on the No. Side of Ned's Branch, runing No. 30 Et. 180 pole to a pine, thence So. 60 Et. 180 pole to a pine, thence So. Wt. 180 pole to a sweet gum in Ned's Branch thence up the branch with the run to the begining two hundred acres of land being the property of the said William Hines, did according to law advertise and enpose the same to sale on the thirteenth day of July in the year aforesaid, and the said John Sulliven being then and there present, upon the premises on the said thirteenth day of July aforesaid, did bid off the said tract of land at the sum of fifteen thousand pounds current money as was the last and highest bideer. Now this indenture witnesseth that the said Theophilus Williams Sheriff of Duplin County aforesaid by virtue of and in persuance of his said office and the writ aforesaid and for and in consideration of the sum of fifteen thousand pounds current money to the said Theophilus Williams in hand paid before the sealing and delivery of these presents the receipt whereof the said Theophilus Williams doth hereby acknowledge, hath granted bargained and sold aliend enfeoffed assigned and set over, conveyed and confirmed by virtue of his said office, and in persuance of the writ aforesaid as fully as he can and is thereby empowered and enables, doth by these presents, grant bargain and sell enfeoffs transferr assign and set over convey, and confirm unto the said John Sulliven andd the aforesaid tract of land containing two hundred acres, sittuate lying and being as before mentioned, with all the woods waters profits and advantages whatsoever to the said two hundred acres of land and of every part and parcel thereof belonging or in any wise appertaining, and all the estate right title interest claie or demands of the said William Hines therever to have & to hold the said tract of land herein mentioned or intended to be granted sold aliened transfered assigned set over conveyed & confirmed into the said John Sullivan his heirs and assigns forever & to the only proper use benefit and behoof of the said John Sulliven his heirs and assigns forever, in as full and ample manner as he the said Theophilus Williams Sherif of Duplin County aforesaid by virtue of his office of Sheriff, and in exeution of the writ aforesaid and is hereby enabled to convey after transferr and change the same and the said Theophilus Williams doth covenant promise and agree to and with the said John Sulliven his heirs and assigns, that the said Theophilus Williams Sheriff of Duplin County aforesaid will warrant and defend the said granted and bargained premises unto the said John Sulliven his heirs & assigns agains the said Theophilus Williams and his heirs and against every other person or persons claimuing under him the said Theoph. Williams his heirs or assigns sofar as his is impowered and enabled by virtue of his said office of Sheriff and pursuance of the act of Assimbly in such case made and provided. In witness whereof the said Theophilus Williams hath hereunto set his hand & seal the day and date first above written. Theophilus Williams Signed Sealed & delivered in presence of Mary Munk Andrew Guffird State of No. Carolina, Duplin County, October Court 1784.
