(Transcribed by Joan S Dunn) Deed Book 1 A Page 108, 109, & 110 Sutton Byrd To Lewis Thomas Deed for 210 acres of lands This indenture made the fifteenth day of January & in the year of our Lord one thousand seven hundred & eighty five and in the ninth year of the American Independancy, between Sutton Byrd of the State of South Carolina and County of Craven planter, of the one part and Lewis Thomas of Duplin County and State of No. Carolina, planter of the other part. Witnesseth, that the said Sutton Byrd for and in consideration of the sum of forty pounds in gold & silver to him in hand paid by the said Thomas before the ensealing & delivery of these presents, the receipt whereof is hereby acknowledged and the said Sutton Byrd he the said Lewis Thomas doth exonerate acquit & discharge and hath bargained granted and sold & by these presents doth fully and absolutely grant bargain sell alien convey and confirm unto the said Lewis Thomas his heirs and assigns forever a certain tract of parcel of land lying & being in Duplin County butted and bounded as followette Viz. Begining at a black gum in Nahunga Swamp on the north side being the corner of a tract of land formerly lade off for Jesse Jornagan byt now Lewis Thomas's corner & runs thence along the same line No. 30 Et. 60 pole to a red oak & pine, thence No. 62 Wt. 62 pole to a read oak & hickory thence No. 52 Wt. 100 po. to a large pine, thence No. 71 Wt. 120 pole to a black jack, thence So. 5 Et. crossing the branch 60 pole to a pine, thence through Powell's field No. 80 Et. 120 pole to the center of 3 pines, thence So. 48 Et. 92 pole to a pine, thence So. 22 Et. 99 poles to a stake on Mr. Molten's line, but now Lewis Thomas's thence with his line No. 29 Et. 74 pole to a white oak & red oak at the run of Nahunga Swamp his corner, thence up the said run as it meanders to the begining, being about 100 yards and containing in the whole two hundred and ten acres of land formerly conveyed from Henry McCullock Esqr. by a deed of said to Litton Byrd all which premises are more particularly discribed and set fourth in the plan and may therof hereunto annuced, with all rights and priviledges together with all houses and building thereon contained, to have & to hold the said land and all and singular appertenances profits and heriditaments with all woods and all previledges belonging unto him the said Lewis Thomas his heirs executors administrators & assigns forever, and the said Sutton Byrd doth for himself his heirs exectuors administrators and assigns, covenant promise grant & agree to & with the said Lewis Thomas his heirs and assigns that he the said Sutton Byrd at the time of ensealing and delivery hereof is the true sole and lawfull owner of the said land and premises, and hath in himself good rightfull power and lawfull authority to grant bargain and sell the same in manner aforesaid, and that the said Lewis Thomas his heirs executors administrators & assigns and every of them shall and may from time to time and at all times peacebly & quietly have hold use occupy possess and enjoy the said land and premises with the appertenances without any let suit trouble distrubance or interruption of him the said Sutton Byrd his heirs executors administrators or assign or any of them or any other person or persons claiming from by or under him or under them or any of them and that the said tract of parcel of land at the day hereof is and so shall remain for ever continue and be unto him the said Lewis Thomas his heirs & assigns forever, free and freely acquitted exonerated & discharged of and from all manner of forms and other gifts grants bargains sails leasses will intail jointure rents and arnearages of rents quit rents widow dowers and all other incumbrances whatwoever & the said Sutton Byrd for himself his heirs executors & administrators doth covenant promise grant and agree to & with the said Lewis Thomas in manner and form following Viz. that he the said Sutton Byrd and his heirs shall & will at the request of and at the proper cost & charges of him the said Lewis Thomas at any tim or times when therunto demanded make acknowledge perform and execute or cause or suffer to be made acknowledge performed and executed all and every such act & acts deed & deeds which the said Lewis Thomas his heirs executors administrators or assigns or his or their council learned in the law, shall be advised or required better & further assessing and sund making and establishing the said land unto him the said Lewis Thomas his heirs executors administrators and assigns forever. In witness whereof the said Sutton Byrd hath hereunto set his hand & seal the day and year of our Lord above written. Sutton Byrd Signed sealed & delivered in presence of us Jas. Middleton David Middleton State of North Carolina Duplin County January Court 1785. Then was the within deed proved in open Court by the oath of David Middleton & ordered to be registered. Test W.
