(Transcribed by Fran West) SIMON WEST DEED TO JOSEPH WHITLEY FOR 96 ACRES Return made to the Secretary's office 4 April 1768 Duplin County Deed Book 1 [or I] p216, 217 North Carolina Duplin County To all people to whom these presents shall come Know ye that I Simon WEST of the County of Duplin and Province aforesaid Greetings Know ye that I Simon WEST for and in consideration of the sum of thirty two pounds proclamation money to me in hand paid by Joseph WHITLEY of the county and province aforesaid, planter, the receipt whereof is hereby acknowledged and my self therewith fully satisfied contented and paid have given granted bargained sold conveyed and confirmed assigned and set over unto the said Joseph WHITLEY his heirs and assigns forever a certain tract or parcel of land containing 96 acres in Duplin County beginning at ATWELL's corner running N 45 E100 poles to a pine, thence N45 W140 poles to a red oak thence S 45 W120 poles to a read oak by ATWELL's line thence with his line to the beginning. The said tract or parcel of land was granted to Simon WEST by patent bearing date 16th April 1765. To have and to hold the said parcel of land together with all houses orchards gardens fencing timber & trees then standing lying or growing with all woods water and Rivers with all profits commodities and hereditaments unto him the said Joseph WHITLEY his heirs executors administrators doth covenant promise grant and agree to and with the said Joseph WHITLEY his heirs and assigns in manner following that is to say that the said Simon WEST at the ensealing & delivery of these presents hath a good right and title and estate of inheritance in the premises in fee simple and hath full power and lawful authority to bargain and sell the same in manner aforesaid unto the said Joseph WHITLEY his heirs and assigns forever and the said Simon WEST for himself his heirs executors and administrators doth further promise and warrant that the said land and premises is [sic] free from the lawful claims or demands of any person whatsoever and the same will warrant secure and defend unto the said Joseph WHITLEY his heirs and assigns forever.
