Samuel Ashe Junr. To Jacob Boney
Deed for 400 acres lands
This indenture made the eighty day of February in the tenth year of American Independence
and in the year of our Lord Christ, one thousand seven hundred and eighty six, between Samuel
Ashe Junr. of the State of North Carolina and County of New Hanover (Gent.) of the one part, and
Jacob Boney of the State aforesaid and County of Duplin of the other part. Witnesseth that the
said Samuel Ashe for divers good causes and considerations him therunto moving, but more especially
for the valuable consideration of the sum of one hundred and fifty pounds current, money of the
State aforesaid, to him in hand well and truly paid or secured to be paid by Jacob Boney aforesaid
before the ensealing and delivery of these presents, the rect. whereof is hereby acknowledged,
hath by these presents given granted bargained sold assigned and set over to the said Jacob Boney
his heirs and assigns forever, one certain tract or parcel of land situate lying and being in
Duplin County aforesaid, on the North side of Rockfish creek on both sides of the main road, and
both sides of Porter's Branch, being that part of the contents of a paten granted to John Peacock
the fifteenth day of Feby. Anno Domini 1737, and be him sold to the late John Porter. Begining
at a black oak or water oak on the creek bank the first, sation of the paten, thence as the
paten line No. 25 Wt. 172 poles to a pine, thence No. 65 Et. 320 pole crossing the road and
Porter's Branch to a pine, thence So. 25 Et. 206 poles to a pine, thence So. 65 Wt. 182 poles
to a red oak and poplar on the edge of a branch, (said in the paten to be 162 poles) thence down
the branch as it meanders to a Burch at the mouth, thence up the creek by various courses to the
first station, containing in the whole four hundred acres be the same more or less. To have and
to hold the aforesaid land and premises with all the appertenances to the same belonging or in
any wise appertaining of every nature of kind whatever, to him the said Jacob Boney his heirs
and assigns forever, free from all former gifts grants mortgages intails wills executions entents
or troubles whatever and the said Samuel Ashe (Gent.) for himself his heirs executors administrators
and assigns, the aforesaid land & premises with all the appurtenances to the same belonging or
in any wise appertaining to him the said Jacob Boney his heirs and assigns shall and will
warrent and forever defend from and against him the said Samuel Ashe his heirs and assigns, as
also from and against the just and lawfull clame of all and every other person or persons
whatever who may hereafter lay any lawfull claim to the same. In witness whereof the said
Samuel Ashe junr. hath hereunto set his hand and seal the date above written.
