(Transcribed by Joan S Dunn) Deed Book 1 A Page 463, 464, & 465 Phill Southerland To William Southerland This indenture made this twentieth day of December in the year of our Lord 1784, & in the eighth year of the American Independence, Between Phill Southerland of the State of No. Carolina in the County of Duplin of the one part & William Southerland of the same State & County aforesaid of the other part. Witnesseth that the said Phill Southerland for divers good causes & considerations him thereunto moving, but more especially for & in consideration of the sum of one hundred pounds to him in hand paid or secured to be paid before the sealing & delivery hereof, the receipt whereof he doth hereby acknowledge & himself therewith to be fully satisfied and content & thereof and therefrom doth hereby acquit the aforesaid William Southerland his heirs executors administrators assigns hath bargained sold enfeoffed conveyed & confirmed & by these presents for himself his heirs executors administrators hath & doth fully freely & absolutely bargain sedll enfeoffe convey & forever confirm unto the said William Southerland his heirs and assigns, one certain travct or parcel of land containing by estimation two hundred acres be the same more or less, situate lying & being in the above said province & County of Duplin & on the east side of the No. East of Cape Fear River, on both sides of Limestone Creek. Begining at a Burch on the south side of the Creek Francis Brice's lower corner, & runs So. 15 Et. 54 pole to a pine at Samuel Johnston's line, thence with his line SO. 57 Wt. 110 pole to a pine John Atkins' corner, thence No. 45 Et. 180 pole to a pine his other corner, thence No. 60 pole to a pine, thence Et. 160 pole to a pine, thence So. 90 pole to a gum at the Creek, & down the meanders of the Creek to the begining, the said two hundred acres of land being granted to William Foulsom by pattent bearing date September the 16th 1766. To have and to hold the said two hundred acres of land and premises with the appurtenances unto the said William Southerland his heirs and assigns forever in as full and ample manner to all intents & purposes as he the said Phill Southerland did might or could have held the same before the making hereof, & the said Phill Southerland is stands seized of the said lands & premises of an indefeazable estate of inheritance in fee simple, & that in himself hath good right full power & lawfull authority to grant bargain sell convey and forever confirm the said land and premises with the appurtenances unto the said William Southerland his heirs & assigns & that from time to time & at all times forever hereafter, he the said William Southerland his heirs and assigns by power and virtue hereof may & shall enter unto have hold use occupie possess & enjoy the said two hundred acres of land and premises, free & clear and freely & clearly acquitte discharged saved kept harmless & indemnified off and from all former or other gifts grants bargains sails enfeoffements entails jointures dowries execution entents & incumbrances whatsoever the quit rents of said land which shall hereafter become annually due only excepted, moreover the said Phill Southerland doth for himself his heirs executors and administrators warrant to defend the title of the said two hundred acres of land to him the said William Southerland his heirs and assigns forever, free from the lawfull claim of him the said Phill Southerland his heirs executors & administrators or any other person or persons whatsoever, also the said Phill Southerland doth covenant & agree for himself his heirs executors & administrators to & with the said William Southerland his heirs or assigns, that at any time hereafter at the reasonable request of him the said William Southerland his heirs or assigns & at his or their cost and charges in the law, he the said Phill Southerland his heirs executors or administrators shalll and will make or cause to be made and duly executed any further or other deed or instrument of writing for the sure making the title of the said land & premises to him the said William Southerland his heirs executors or assigns forever, as he or they or him or their council learned in the law shall advise devise or require. In witness whereof the said Phill Southerland hath hereunto set his hand & seal the day & year first above written. Phill Southerland Signed sealed & delivered in the presence of Robert Southerland Robert Bishop State of No. Carolina Duplin County October Term 1787.
