(Transcribed by Joan S Dunn) Deed Book E Page 306, 307, & 308 Peter Morris To Theophilus Swinson Deed 100 acres This Indenture this fourth day of May in the year of our Lord Christ on thousand seven hundred and Eighty nine. Between Peter Morris Cooper of North Carolina and County of Duplin of the one part and Theophilus Swinson planter of the other part. Witnesseth that he the said Peter Morris for Diverse good causes and considerations him thereunto moving, but more especially for the consideration of the sum of sixty five pounds Lawfull money of this State to him in hand well and Truly paid by Theophilus Swinson afoarsaid before the Ensealing and Delivery of these presents The receipt whereof he the said Peter Morris doth hereby acknowledge himself to be therewith fully satisfied contented and paid and of every part and parcel thereof doth hereby acquit and forever Discharge the said Theophilus Swinson his heirs and assigns forever and by these presents given granted bargained and sold and forever confirmed to the said Theophilus Swinson aforesaid a certain Tract or parcel of Land situate lying and being in the state and County aforesaid on the East side of Maxfield swamp & on both side of Elder swamp. Begining at a small red oake and Runing Et. 120 poles to a sweet gum and water oake at the Run of the swamp on Patrick Powels line thence along his line No. 114 poles to a pine on the line of an old survey near said Powels corner thence said old line No. 82 WT. 16 pole to a stake thence to the begining containing in the whole one hundred acres be the same more or less being the contents of a Paten granted to Robert Dickson Esquire the 16th ofr December in the year 1769. To have and to hold to him the said Theophilus Swinson his heirs and assigns forever the above bargained Land and premises with all and singular the previledges and advantages thereunto belonging or in any wise appurtaining of every nature and kind whatsoever free and clear from all sett Hindrances and Molstations of him the said Peter Morris his heirs or assigns as also from and against the just and Lawfull claim or any other person or persons who may hereafter Lay any Lawfull Claim to the same free and clear of former gifts grants Judgements Intails Dowers Jointers or any other Incumbrances given or granted by me as also free from all other Incumbrances whatsoever Except the Quiet Rents now due or hereafter may become due on the said Hundred acres of Land and the said Theophilus Swinson the above Bargained Land and premises shall and may have hold occupy enjoy and possess as his own free and Lawfull Inheritance and have full power and authority to sell and convey the same away as he shall think proper. In witness whereof he the said Peter Morris hath hereunto set his hand and seal the day and year first above written. signed sealed & Delivered in presence of Peter Morris William Bush William Noble State of No. Carolina Duplin County July Term 1791 Then was the within Deed proved in open Court by the oath of William Bush and ordered to be Registered.
