John Oliver Excr To Benjamin Oliver

This Indenture made this 13th day of July 1839 Between John Oliver as Executor of Francis
Oliver decd of the County of Duplin in the State of North Carolina of the one part and Benjamin
Oliver of the same place ot the other part witnesseth that when as the said Francis Oliver
Decd in his last will duly proven & recorded in the Coutny of Duplin did direct his Lands to
be sold by his Executors for certain purposes therein mentioned after the demise of his wife
who was then living and where as the said demise hath taken place and the said John Oliver in
compliance with the Trust committed to him in the will aforesaid did advertise the sale of the
said Lands and crops for sale at public vendue on the first day of August 1838 when Benjamin
Oliver appearing on the premises at the sale aforesaid did bid off the said Lands at the sum
of one Thousand Dollars & was the last & highest bidder. Now this Indenture witnesseth that
the said John Oliver Executor as aforesaid for and in consideration of the said sum of one
Thousand Dollars to him in hand paid or secured to be paid before the signing and delivery of
these presents the receipt of which is hereby acknowledged hath granted bargained and sold and
do by these presents grant bargain sell set over & deliver unto the said Benjamin Oliver the
following tracts or parcils of Land in Duplin County and on the waters of Bear Marsh (viz) one
tract Begining at a stake on the Run of Bear marsh Carrs corner & runs with his line No 75 wt
88 3/4 poles to a stake then No 35 wt 74 poles thence No 5 wt 16 poles to a pine then wt 88
poles to a large pine then No 200 poles to a pine then Et 200 poles to a pine in the field then
so 60 Et 51 poles to a post oak stump in the field then No 82 Et 20 poles to the run of Bear
Marsh then down the same as it meanders to the first station containing three hundred & seventeen
acres more or less Also one other tract lying at the Head of Shuffields Branch & North East
pocoson begining at a pine down on the west side of the little pocoson & runs No 30 1/2 wt 257
poles to a large post oak at the corner of Adam Wynns field then so 3 Et 85 poles to a pine then
so 79 wt 223 poles to a black jack then so 28 Et 62 poles to a black jack then so 35 wt 91 poles
to the first station containing two hundred and sixty four acres more or Less to have & to hold
the said bargained lands & premises to the said Benjamin Oliver and his Heirs forever and the
said John Oliver doth bind himself his Executors & administrators so far as he is empowered by
virtue of his station as Executor aforesaid & in obedience to the last will of Francis Oliver
decd to defend and secure the title of the before mentioned Land & premises to the said Oliver
& his Heirs free from incumbrance and from and against the Lawfull claim of any person or persons
claiming by or under the said Francis Oliver of His heirs or assigns In witness whereof I have
hereunto set my hand & seal the date first written signed in presence of us
