John Magee To Ebenezer Garrison
Deed for 50 acres lands
This indenture made the twenty fourth day of August in the twelveth year of American
Independence and in the year of our Lord Christ one thousand seven hundred and eighty seven
Between John Magee of the State of No. Carolina & County of New Hanover nigh the town of
WIlmington of the one part & Ebenezer Garrison planter of Duplin County of the other part,
Witnesseth, that the said John Magee for the valuable consideration of the sum of thirty five
pounds current money to him in hand paid by the said Ebenezer Garrison before the ensealing &
delivering of these presents, the receipt whereof is hereby acknowledged, he the said John
Magee doth by these presents grant & bargain sell alien & confirm unto the said Ebenezer
Garrison his heirs and assigns forever, one certain tract or parcel of land situate lying &
being in Duplin County on the marsh branch near Muddy Creek it being part of two surveys of
land one patened by William Magee and the other was patend by John Magee containing in the
whole fifty acres of land more or less, bounded as follows. Begining at a red oak on the south
side of the mill branch upon William Farrior's line, then along a round of marked trees southward
to a pine, thence a So. Wt. by some more marked trees to a pine near a pond, thence a No. Wt.
course to a pine upon Thomas Blake's line, thence No. Et. along Blake's line to William Farrior's
corner, thence down the marsh branch with Farrior's line to the beginig. To have and to hold the
aforesaid land with all the improvements to the same belonging or in any wise appertaining of every
nature or kind whatever, free from all former gifts grants mortgages wills dowories right or title
of dowers or any other incumbrances whatever given granted or done by him the said John Magee or any
other person or persons whatever by from or under him or them or any of them & the said Ebenezer
Garrison the aforesaid land & premises shall and may have hold use keep enjoy & possess as his own
free and lawfull inheritance, free from all incumbrances whatever. The taxes as they become due
only excepted, & the said John Magee the aforesaid land & premises to him the said Ebenezer Garrison
his heirs & assigns shall and will warrant & defend from and against the said John Magee his heirs
and assigns, as also from and against the just and lawfull claim of all and every other person or
person whatever, who may hereafter lay any lawfull claim to the same. In witness whereof the said
John Magee hath hereunto set his hand & seal the date above written.
