(Transcribed by Joan S Dunn) Deed Book 1 A Page 34 & 35 John Magee To Ebenezer Garrison Deed of 135 acres of lands State of North Carolina, Duplin County. To all people to whom these presents shall come, Greeting. Know ye that I john Magee in the State & County aforesaid, for and in consideration of thirty pounds specie, to him in hand paid or cause to be paid before the sealing and delivery hereof by Ebenezer Garrison of the County & State aforesaid the receipt he doth gereby acknowledge and himself therewith to be fully satisfied and content and paid and thereof every part and parcel thereof to aquit exonerate and discharge the said Ebenezer Garrison his heirs executors and administrators firmly by these presents, have given granted sold aliened conveyed and confirmed and by these presents do fully freely & alsolutely give grant bargain sell convey and confirm unto him the said Ebenezer Garrison his heirs and assigns forever a certain tract of parcel of land containing by estimation one hundred and thirty five acres, lying and being in the County of Duplin and State aforesaid situate lying and being on the east side of No. East Branch of Cape Fear River and on a certain branch of Munfy Creek. Known by the name of Marsh Branch it being a part of the plantation whereas the said Ebenezer Garrison now doth live on, and on the South side of said Marsh Branch. Beginning at or near a Black small gum or stake below a small branch running into the Marsh branch, and Mill pond; thence up the So. East side of the said small branch by a some of marked trees into a pine in a back patent line of John Magee, bearing date the 22nd day of December 1770; then up the said line to a pine James Black's corner; thence to a stake in a branch; thence down said branch to the first station . To have and to hold the said plantation tract or parcel of land containing one hundred and thrity five acres, be the same more or less, together with all and singular the houses out houses your garden barns stables or hand field area down fences woods under woods timber and timber trees with all previliges & appurtenances to the same belonging or in any wise appertaining to him the said Ebenezer Garison his heirs executors administrators or assign shall & may from time to time and at all times. Have hold ever possess and enjoy for bargained premises and apppurtenances to the same belonging or in any way appertaining to him the said Evenezer Garrison his heirs executors administrators and assigns forever, to his of their own proper use benefit & behoof and I the said John Magee for myself my heirs executors & administrators do comand and agree to and with the said Ebenezer Garrison in manner and form following that is to say that he the said Ebenezer Garrison his heire executors administrators and assigns shall and may from time to time and at all time, have hold occupy possess and enjoy the pre bargained premises and appurtenances and every part and parcel thereof free and clear of and from all manner any charges and incumbrances wharsoever made done or committed by me the said John Magee or any person by my order means procurement and he the said Ebenezer Garrison his heirs or assigns pay my the yearly tax aquinted to the land in his possession, and I the said John Magee my heirs Execs. Admins. the prebargained premises and appurtenances and every part and parcel thereof do warrant and forever defend unto him the said Ebenezer Garrison his heirs executors and assigns against the lawful claim or claims of and from all manner of person or persons whatsoever laying any lawful claim to the same by these presents. In witness whereof I the said John Magee have set my hand and fixed my seal this 13th day of December in year of our Lord one thousand seven hundred and eighty three-1784. John Magee Signed sealed and delivered in the presence of us Charles Bostick William Farrior State of North Carolina, Duplin County, July Court 1784.
