(Transcribed by Joan S Dunn) Deed Book E Page 219, 220, 221, 222, & 223 John Hill & Jean his wife To Curling Smith Deed 410 acres This Indenture made the fourth Day of August one thousand seven Hundred and ninety and in the fifteenth year of American Independence Between John Hill and Jean his wife of the one part and Curling Smith of the State of Virginia of the other part Witnesseth, that the said John Hill and Jane his wife of the County of Duplin and State of North Carolina for and in consideration of the sum of Four Hundred pounds good and Lawfull money of the state aforesaid, to him in hand well & truly paid before the Ensealing and Delivery of these presents the Receipt whereof he the said John Hill and Jane his wife doth hereby acknowledge and himself to be therewith fully contented and paid, have given granted bargained and sold conveyed confirmed assigned and set over, unto him the said Curling Smith and by these presents for himself his Heirs Executors and administrators doth give grant bargain sell convey confirm assign and set over unto the said Curling all that piece or parcel of Land and Plantation in the state and County aforesaid on the south side of Goshen swamp between the Cross branch and wildcat branc the place whereon William Hooks formerly lived, and being the lower part of a Tract of Land which Thomas Hooks purchased from William Cannon Juor. and which he said Cannon purchased from Henry McCulloh Esquire, and which is butted and bounded as follows (to wit) Begining at a maple at the mouth of Cross Branch in the Goshen swamp William Cannon Juniors corner tree and runs thence along his line up the cross branch So. 40 Wt. 224 poles to a small white oak and red oak saplin thence along William Cannon Jr. line No. 66 Wt. 40 pole to a large white oak in small branch thence Down the Run of the said Branch as it Meanders to the Run of Wild Cat Branch thence Down the Run of Wildcat branch as it meanders to Goshen swamp thence Down the swamp with Thomas Hookes line to the Begining containing in the whole two Hundred and Ten acres of Land. And also one other Tract of Land containing two Hundred acres lying and being in the County of Duplin and state aforesaid on the south side of Goshen Swamp, and on the dreains of Cross Branch, begining at a small white oak the said William Hooks's corner Tree at the above granted premises on John Wards line by the Cross branch, Thence as Wards line So. 40 Wt. 28 pole to a stake at his corner, thence along Wards, other line So. 50 Et. 152 poles to a pine, thence alonb his other line of a survey of a Eighty acres south 49 Wt. 120 poles to a pine his corner, thence the same course 60 poles to th Road thcne along the main road No. 46 Wt. 134 poles to Thomas Hookses line and as his line No. 18 Et. 14 poles to a pine his corner, thence the same course along Thomas Hookses line of a new survey 188 poles to a black jack, thence to the begining containing two Hundred acres of Land as may more fully appear by a Pattent bearing Date the Fifteenth day of December 1778 and in the third year of American Independence be the same more or Less. The first above Described Tract of Land which contain Two Hundred and Ten acres is conveyed by Deed bearing date the 19th day of September 1786 from William Hooks to William Kenan as by the said deed may more fully appear which deed doth also convey the last described two hundred acres, which two places or parcels of land by the Death of William Kenan hath decended to the said John Hill & Jane his wife The above grantors To have and to hold to him the said Curlin Smith his Heirs and assigns forever all and singular the above two described pieces or parcels of Land containing in the whole Four Hundred and Ten acres of Land and Plantation Together with all the profits benefits and advantages thereunto belonging or in any ways appurtaining unto him the said Curlin Smith his Heirs and assigns forever as a good perfect and absolute Estate of inheritance. And the said John Hill & Jane his wife doth hereby for himself his Heirs Executors and Administrators, covenant promise & agree to and with him the said Curling Smith to keep harmless and Indemnifie him the said Curling Smith his heirs and assigns forever in the Quit and peaceably possession of the said Four Hundred and Ten acres of Land and Plantation hereby granted and sold together with the Houses fields orchards and other improvements woods waters appurtainances & Previledges thereunto belonging or in any wise appurtaining to him the said Curling Smith will warrant secure and Defend him and against the just and Lawful claim of him the said John Hill and Jane his wife his Heirs or assigns and from and against the just and Lawful claim of any other person or persons whatsoever. And that free and clear and freely and clearly acquited of and from all manner of incumbrances and Troubles whatsoever Except the Taxes that may be charged thereon by the public in future. In Witness, whereof the said John Hill and Jane his wife hath hereunto set their several hands & fixed their seals the day and year first above written. signed sealed & delivered in the presents of John Hill Thos. ROutledge Jean Hill Ivy Smith State of No. Carolina Duplin County April Term 1791 Then was the within deed proved in open Court by the oath of Ivey Smith and oredered to be registered. Test W. Dickson C. C. Duplin County This may certify that as a Justice of peace for said County I did Examine Mrs. Jean Hill with Respect to the execution of the within Deed who declared she did assign the same without any restraint which is acknowledged this 6th August 1790 Before Thos.
