John Foley To Francis Oliver
Deed for 325 acres lands
This indenture made this twenty ninth day of April in the year of our Lord one thousand
seven hundred and eighty five, between John Foley of George Town District State of South
Carolina of the one part, and Francis Oliver of the County of Duplin, State of No. Carolina of
the other part. Witnesseth that for and in consideration of the sum of one hundred & seventy
five pounds specie to the said John Foley in hand paid by the said Francis Oliver before the
sealing and delivery of these presents the receipt whereof he doth hereby acknowledge & therefore
doth release acquit and discharge the said Francis Oliver his heirs executors and administrators
by these presents, he the said John Foley hath granted bargained sold aliened and confirmed &
by these presents doth grant bargain sell alien & confirm unto the said Francis Oliver and his
heirs a certain piece or parcel of land sittuate lying and being in the County of Duplin and
State of No. Carolina, on the north side of Goshen swamp and on Bear Marsh, bounded as follows.
Begining at a pine on said Marsh and runing Wt. 180 poles, thence No. 180 poles to a pine,
thence Et. 180 poles to a pine, thence a right line to the first station, containing two hundred
acres granted to the said John Foley, paten bearing date the seventh day of March Anno Domini
1759, also one other tract or parcel of land joining to the above tract on both sides of Bear
Marsh between the above mentioned two hundred acres and Weston's formerly now Bowden's lands
bounded as followeth. Begining at a pine at or near a pond near the first line up the above
two hundred acres, thence runing So. 5 E. 5 chains to a pine, South 35 Et. Twnety two chains to
a pine, East 12 chains to a red oak No. 62 Et. twelve chains and fifty links to a pine over Bear
Marsh, thence No. 34 Et. 42 chains to a scrub oak, thence No. 25 chains to the centre of two
Hickorys & a pine, thence So. 62 Wt. 24 chains to a pine by Bear Marsh, being the line of the
above mentioned, two hundred acres, thence down the marsh So. 35 chains to a pine, and thence
to the first station, containing one hundred and twenty five acres granted as to the said John
Foley paten bearing date twenty third day of April 1762, and now conveyed the whole of it, that
is both tracts by the said John Foley to the said Francis Oliver as by this deed doth fully
appear, with all houses buildings orchards ways water & water courses profits commodities
hereditaments and appurtenances whatsoever, to the said premises hereby granted or any part
thereof belonging or in any ways appertaining & the reversion & reversions rents issues and
profits whereof, and also all estate title claim and demand of him the said John Foley of in
and to the said premises. To have and to hold the said land hereby conveyed and all and
singular this the premises hereby bargained and sold and every part & parcel thereof, with
their and every of their appurtenances to the said Francis Oliver his heirs and assigns forever,
and the said John Foley for himself his heirs executors and administrators, doth covenant
promise and grant to and with the said Francis Oliver his heirs and assigns by these presents
that the said John Foley now at the sealing and delivery of these presents, is seized of a good
sure perfect and indefeazable estate of inheritance in fee simple of in and to the premises
hereby bargained and sold and that he has full power and lawfull authority to grant, and convey
the same to the said Francis Oliver in manner aforesaid, and that the said premises now is and
so forever shall remain free and clear from all manner of gifts grants bargains sales dowers
and right of dower judgements executions titles troubles charges and incumbrances made done
committed or suffered by the said John Galey or any other person whatsoever, the taxes that may
hereafter become due on the same only excepted, and that the said John Foley and his heirs all
and singular the premises hereby bargained and sold with the appurtenances to the said Francis
Oliver his heirs and assigns against, him the said John Foley and his heirs, and all and every
person and persons whatsoever, shall warrant and forever defend by these present. In witness,
whereof the said John Foley hath hereunto set his hand and seal the day and year above written.
