(Transcribed by Joan S Dunn) Deed Book 12 Page 48, 49, & 50 John E Hussey Shff To James Carr Deed 733 acres State of North Carolina Duplin County Whereas by virtue of a writ of Fieri Facias issued by the clerk of the Cour of please and Quarter Sessions of Duplin County aforesaid directed to the Sheriff of said County and being tested the third monday of January last part commanding him that of the goods & chattles lands and tenements of Gabriel Whitman in said County he case to be made the sum of Two hundred (hundred) and fifty dollars principle intrest five dollars with interest on principle from 16th April 1838 tile paid which Barnett Carr the said Court Lately recovered against the said Gabriel Whitman for a certain debt & damages and also the further sum of nine dollars and sixty five cents by the said Court adgudged for his costs & charges by him in his suit in that behalf expanded and that he should have the said monies before the said Court at the next Court to be held for the said Counry on the third monday of April next to render the said plaintiff the debt damages & costs aforesaid whereof the said defendant was convicted I John E Hussey Sheriff by James Maxwell Deputy Sheriff of said County levied upon a certain piece or tract of Land lying in Duplin County herein after now particularly described of the land and tenements of Gabriell Whitman and having advertised agreeably to Law on the 16th day of April instant sold the same to James Carr of said County being the highest bidder at and for the price of one hundred dollars Now Know all men by these presents that I John E Hussey Sheriff as aforesaid by virtue of and in obediance to the aforesaid writ of Fieri Facias and by authority of my said office for and in consideration of the said sum of one hundred dollars to me in hand paid by the said James Carr at our before the sealing of these presents the receipt whereof is hereby acknowledged have bargained sold & confirmed and I do hereby bargain sell and confirm to the said James Carr the said tract of land and all the right title & estate which the said Gabriel Whitman has in and to the same lying and being on Loves pocoson begining at a stake in the place of a red oak and runs thence North 33 wt 184 poles to a stake thence 63 poles to a stake thence No 60 wt 146 poles to a pine on John Mallards line thence with John Mallads other line So 44 wt 102 poles to a pine John Mallards corner thence with his other line so 8 wt 26 poles to a pine John Mallards corner thence with James Carrs line so 6 Et 136 poles to a Stake James Carrs corner thence with James Carrs other line so 40 wt 172 poles to a stake on a ditch Carrs other corner thence with Carrs line so 49 Et 32 poles to a stake Carrs corner on Loves pocoson thence so 88 Et 176 poles to a stake thence So 3 wt 37 poles to a pine thence Et 80 poles to a pine then so 37 Et 60 pole to a pine then so 27 Et 35 poles to a stake thence No 77 Et 84 poles to a pine thence to the Begining containing seven hundred and thirty three acres more or Less to have and to hold the said piece or parcil of Land with all and every appurtenances then unto Belonging or appurtainining to the said James Carr his heirs and assigns forever in witness whereof I have hereunto set my hand and seal at Kenansville the 16th day of April 1839 and in the 63rd year of the independance of said State John E Hussey Shff by Jas Maxwell Dff signed sealed and delivered before James Dickson WItness Yates Brooks I A Kornegay State of North Carolina Duplin County Court of please and Quarter Sessions July term 1839 The Execution of the within deed is duly proved in open court by the oath of Yates Brooks one of the subscribing witnesses thereto and is ordered to be Registered Copy N Routledge Rgr Test James Dickson Clk
