James Sullivan to Elisha Sullivan -- 1837

(Transcribed by David Dunn) James Sullivan to Elisha Sullivan 158 acres North Carolina, Duplin County: This indenture made this day of January in the year of our Lord 1837 between James Sullivan of the county and state aforesaid of the one part and his son Elisha Sullivan of the county and state aforesaid of the other part. Henceforth for in consideration of the sum of Ten dollars to the said James Sullivan In hand paid by Elisha Sullivan at or before the sealing and delivery of these presents the receipt where of is hereby acknowledged there of to be therewith fully satisfied consented of and given, granted, bargained or sold to give, grant, bargain or sale align, convey, confirm thereof and set over to Elisha Sullivan, his heirs and assigned forever the following track or parcel of land, scheduled lying and being in the County and State aforesaid. First reserving to myself and wife Sarah Sullivan all of that part of said tract that lies on the South side of the Wolf Scrape Branch for and during our natural lifetimes, which said tract of land is bounded as follows: Beginning at a small Pine on the run of the Wolf Scrape Branch South at 70 Poles to a pine on the old line South 35 West 64 poles to a stake the old corner then West 190 poles then North crossing the Wolf Scrape 200 poles to a pine, South 72 poles East 136 poles to a Bay Water Oak on the run of ???? branch then down the run of said branch as it meanders about 82 poles to a Black Gum and White Oak at the mouth of said branch at the run of the Wolf scrape thence up the run of the Wolf scrape as it meanders to the beginning containing 158 acres to have and to hold, the before bargained land and premises fully acquitted and discharged of all manner of encumbrance or encumbrances whatsoever to him, the said Elisha Sullivan his heirs, executers, administrators and assigned forever only as before reserved and the said James Sullivan do this for his part oblige himself his heirs executors administrators and assigns to warrant secure and forever defend the before bargained land and premises free and clear of and from the just lawful claim or demand of all and every other person or persons whatever claming any right title interest use or trust or property in the same or any part or parcel thereof.
