James Williams & Wife To James Gillespie
Deed for 500 acres lands
This indenture made this fourth day of December in the year of our Lord one thousand
seven hundred and E. four & in the ninth year of American Independance between James Williams
and Elce his wife of the one part of the County of Duplin and State of North Carolina, and
James Gillespie of the State and County aforesaid of the other part, Witnesseth, that the said
James Williams for and inconsideration of the sum of three hundred & thirty pounds specie to
him in hand will & truly paid before the ensealing & delivery of these presents by the said
James Gillespie, the receipt whereof he doth hereby acknowledge and himself to be fully
satisfied therwith contented and paid & of all & every part & parcel therof hath given granted
bargained sold alined enfeoffed conveyed confirmed & set over unto the said James Gillespie and
by these presents doth freely fully & absolutely give grant bargain sell alien enfeoffe convey
confirm assign and set over unto the said James Gellespie his heirs and assigns forever, all
that tract or parcel of land situate lying and being in Duplin County aforesaid. Begining at a
red oak on the South side of Marsh Branch by the head of a small branch & runs No. 10 Wt. 66
pole to a pine, thence No. 75 Wt. 80 pole to a black oak thence So. 60 Wt. 66 pole to a white
oak, thence No. 32 Wt. 62 pole to a pine, thence No. 65 Wt. 106 pole to a pine, thence No. 16
Et. 136 pole to a large pine in the fork of the marsh Branch, thence So. 76 Et. 46 pole to a
small pine & black oak, thence So. 50 Et. 118 pole to a red oak, thence So. 85 Et. 248 pole to
a pine, then So. 40 Et. 174 pole to a pine, thence crossing the Marsh Branch So. 55 Wt. 200
pole to a red & white oak by a branch, then No. 70 Wt. 126 pole to a small pine, thence No. 35
Wt. 34 pole to the begining, containing in all five hundred acres of land, being the whole of a
tract of land purchased by the said James Williams of Henry McCulloch Esqr. as by deed from
Henry E. McCulloch bearing date the seventh of November in the seventh year of our Soverign
Lord George the third may more fully appear. To have and to hold the said bargained land and
premises with all and singular the rights members & appertenances therunto belonging or in any
wise appertaining to him the said James Gillespie his heirs and assigns forever in as full and
ample manner as he the said James Williams by his deed migh or could enjoy without the least
hindrance molestation or interuption of him the said James Williams his heirs or assighs and
that free & clear freely & clearly acquited of all and all manner of former or other gifts
grants bargains sails leases will mortgages intails jointure judgements dowers executors
intents or troubles of any kind wharsoever had made or done by him the said James Williams his
heirs or assigns except such taxes as may become due to the State, and the said James Williams
doth hereby further covenant & engage for himself his heirs executors or assigns to warrant and
defent the said James Gillispie his heirs or assigns in the quiet & peaceble possession of the
said bargained lands & premises with the appertenances from and against the lawfull claim and
demand of any person or persons whatsoever claiming or to claim by from or under him the said
James Williams his heirs or assigns or any other whatsoever and the said James Williams doth
promise for himself his heirs & assigns that at any future time at the reasonable request of
him the said James Gillespie his heirs or assigns at his or other cost make or cause to be made
& duly executed any deed or other conveyances he or they or their counsels may advise devise or
require for the same making the said lands and premises to the said James his heirs & assigns
forever. In witness whereof the said James Williams & Elec his wife hath herunto set their
hand & seals the day and year first above written.
