(Transcribed by Joan S Dunn) Deed Book 1 A Page 178, 179, & 180 James Wallace To Joseph Willson Deed for 180 acres lands This indenture made the tenth day of December in the year of our Lord one thousand seven hundred and eighty four, between James Wallace Junr. planter of the State of No. Carolina and County of Duplin of the one part, and Joseph Willson of the State and County aforesaid. Witnesseth that he the said James Wallace for divers good causes and considerations him thereunto moving, but more especially for the consideration of the sum of twenty six pounds current money of the State aforesaid to him in hand well and truly paid by the said Joseph Willson before the ensealing and delivery of these presents, the receipt whereof the said James Wallace doth hereby acknowledge himself to be therewith fully satisfied contented and paid, and hath by these presents given granted bargained sold aliened enfeoffed and conveyed and confirmed and set over and by these presents doth give grant bargain sell aliem enfeoffe convey and confirm unto the said Joseph Willson his heirs and assigns, two certain small tract of pieces of land sittuate lying and being in the State & County aforesaid, one eighty acres of said land being part or half of sixty acres patend by Robert Dickson on the 26th of October 1767, and afterwards conveyed by deed from Robert Dickson to Andrew Wallace, the deed bearing date the first day of January, thence from Andrew Wallace conveyed by deed unto James Wallace bearing date February the 10, 1778, and then from said James Wallace by deed conveyed unto Joseph Willson the day and year above written being on the South side of Maxwell swamp and No. side or Partons & Cabbin branch Viz. Begining at a water oak the first station two of the paten, runing thence So. 32 Et. 82 poles to a poplar, thence So. 58 Wt. 60 poles to a pine, thence No. 32 Et. 61 poles to a black jack, thence to the begining, containing in the whole eighty acres be the same more or less etc., the other small tract or parcel of land joining to the aforesaid land Viz. containing one hundred acres being patened by him the above said James Wallace the said paten bearing date November the tenth 1784,as doth appear by paten containing two hundred acres, lying and being in State & County aforesaid on the So. side of Maxwell swamp and No. side of Cabbin & Partons branch and on each sides of Indian Grave Branch. Viz. Begining at a pine on his own line a little above his house, thence So. 55 Wt. 90 pole to a small pine, thence No. 35 Wt. 180 poles to a pine, thence No. 55 Et. 90 poles to a water oak in a branch a little above Robert Stone's corner, thence to and with Stone's own line to the first station, containing by estimation one hundred acres, be the same more or less. To have and to hold the above said land and premises to him the said Joseph Willson his heirs and assigns forever, and to their only proper use benefit and behoofe, and all and every of the appurtenances with all their woods waters, and water courses mines & minerals horses barns & stables gardens & orchards & their other improvements thereunto belonging, and he the said James Wallace doth for himself his heirs executors administrators and assigns, in manner & form following, that is to say, that the said Joseph Willson his heirs & assigns shall and may from time to time and at all times hereafter quietly and peacebly to hold use occupie possess and enjoy the prebargained land tenements and improvements and every part & parcel thereof freely and clearly from all other gifts deeds leases dowers mortgages sails and incumbrances whatsoever, and he the said James Wallace his heirs executors admins, and assigns forever doth hereby warrent and forever defend the said land tenements heriditaments & premises with all their appurtenances unto him the said Joseph Willson his heirs and assigns forever, and against all lawfull clames or demands whatsoever, with all other rights and priviliges thereunto belonging freely and clearly as his own right, and property to use occupie lett sell possess and enjoy and only the yearly taxes executed that is due now on said land or hereafter shall be laid by the General Assembly of this State. In witness whereunto the said James Wallace hath hereunto set his hand and fixed his seal the day and year first above written. James Wallace Signed sealed & delivered in the presence of us Jacob Bebbent William Phillman State of No. Carolina, Duplin County, January Court 1785.
