High Sheriff To William Duncan Deed for 2 pieces of lands This indenture made the third day of September in the year of our Lord Christ one thousand seven hundred & eighty four and in the eighth year of American Independance between James Pearsall Exqr. High Sheriff of the County of Duplin in the State of North Carolina of the one part and William Duncan of the same County of the State aforesaid on the other part. Whereas the State write of Vendicione Enponas and Fieri Facias issuing from the County Court of Duplin aforesaid in the following words to wit. State of North Carolina. To the Sheriff of Duplin County Greeting: You are hereby commanded that of the goods and chattels land and tenements of Herman Bass if to be found in you Bailywick you cause to be made the sum of sixty pounds specie, which lately in the County Court of Pleas and Quarter Sessions at Duplin Thomas Hook's recovered against him the said Herman Bass for damages and also the sum of three pounds sixteen shillings and nine pence specia for cost and charges in the said saik expended, whereof the said Hermon Bass is convicted and liable as appears to us of recore, and have you the said monies before the Justies of the said County Court at Duplin aforesaid on the third monday of October next, there & there to satisfie and pay the said Thomas Hooks the damages cost and charges aforesaid together with your own fees for this service, herein fail not and have you then and thece this writ. Witness William Dickson Clerk of the said Court at Duplin the 24th day of July in the eighth year of American Independance Anno. Dom. 1783. By virtue of which said writ the said Sheriff did enter upon and take possession of two certain tracts or parcels of land on the South side of the North East swamp in the said County of Duplin, joining and below William Duncan's plantation bounded as follows to wit. one parcel of land beginning at a small water oak on the run of the North East on Teaque's upper line & runs thence South 42 Et. 76 pole to a pine Teaque's old corner, thence North 32 Et. 80 pole to a Black Jack at his other corner, thence No. 77 Et. 28 pole to a pine by Draper's corer; thence by a line of mark'd trees which divids Bass's land from Solomon's No. 15 Wt. 132 to a maple on the run of the No. Et. a little above the mouth of the Calf Pasture branch and thence up the run of the North East swamp as it meanders to the begining; containing eighty acres, which was a part of a tract of three hundred acres which was formerly granted to William Teaque and since by several convey areas and transferences became the property of Andrew Bass and since the decease of the said Andrew Bass is becom the property of Hermon Bass being the oldest son and heir at law to the said Andrew Bass dc. and the other tract of piece of land adhoining the above mentioned piece of land is bounded as follows to wit, begining at a pine by Edmund Duncan's line and runs with the same No. 32 Wt. 180 pole to a white oak by Bass's line in the saide of the No. Et. swamp, thence along Bass's line So. 42 Et. 70 pole to a pine his corern, thence No. 45 Et. 100 pole to a pine by Solomon's line, thence East 50 pole to a pine, thence South 32 Et. 8- pole to a pine, and thence a straight line to the begining, containing one hundred acres, being formerly patented by Thomas Draper and by him sold & conveyed to Andrew Bass and since by the secease of the said Andrew Bass became the property of the said Hermon Bass being the oldest son and heir at law to the said Andrew Bass deceased, and the said two tracts or parcels of land containing one hundred and eighty acres in the whole being advertised according to law, were exposed to sale at public bendue on the second day of September in the year of our Lord 1783 and the said Wm. Duncan being there an thene on the premises, on the day aforesaid did bid off the said two tracts or parcels of land containing in the whole one hundred and eighty acres at the sum of thirty five pounds specie and was the last and highest bider, now this indentrue witnesseth that the said James Pearsall Sheriff of Duplin County aforesaid by virtue of and in perrsuance of his siad office and the writ aforesaid and for and in consideration of the said sum of thirty five pound specie to the said James Pearsall in hand paid before the sealing & delivery of these presents, the receipt whereof the said James Pearsall doth hereby acknowldege hath granted bargained sold aliened enfeossed asigned set over conveyed and confirmed by virtue of his said office & in pursuance of the writ aforesaid as fully as he can and is hereby emporrered and enabled, doth by these presents grant batgain sell alein esfcoff transfer assign and set over convey and confirm unto the said Wm. Duncan all the aforesaid two tracts or parcels of land situate lying and being as before mentioned with all the woods waters profits and advantages whatsoever to the two said tracts or parcels of land and every part and parcel thereof & all the estate right title and interest claim or demand of the said Hermon Bass therein. To have and to hold the said two tracts or pieces of land mentioned or intended to be granted sold aliened transferred set over assigned conveyed and confirmed unto the said Wm. Duncan his heirs and assigns forever, to the only proper use benefit and behoof of the said William Duncan his heirs and assigns forever in as full and ample a manner as he the said James Pearsall Sheriff of Duplin County aforesaid by virtue of his office of Sheriff and in execution of the writ aforesaid and is hereby enabled to convey after transfer & change the same and the said James Pearsall doth covenant promise & agree to and with the said William Duncan his heirs and assigns that the said James Pearsall Sheriff of Duplin County aforesaid will warrant and defend the said granted and bargained premises unto the said William Duncan his heirs and assigns against the said James Pearsall and his heirs and against every other person or persons claiming under him the said James Pearsall his heirs or assigns so far as he is empowered and enabled by virtue of his said office of Sheriff and in pursuance of the act in such case made and provided. In witness whereof the said James Pearsall hath hereunto set his hand & seal the day & year first above written. J. Pearsall Signed sealed and delivered in the presence of us Daniel Glisson Edwd.
