To John Whitehead Deed 200 acres This Indenture made the twentieth Day of October in the year of our Lord Christ one thousand seven Hundred and Eighty nine. Between James Pearsall esquire high sheriff of Duplin in the State of North Carolina of the one part and John Whitehead of the same place of the other part whereas by the state writ of Vedition Exponas and Fieri Farras issuing from the Court of Pleas and Quarter sessions in the County of Duplin in the following words to wit. state of North Carolina. To the sheriff of Duplin County Greeting. Whereas Lately in the County of Duplin a judgement was obtained by Bryan and Needham Whitfield against Edward Cornwallis Debruhl and Theophilus Williams before William Beck for the sumof Five pounds six shillings and ten pence, with costs and whereas Execution did issue from the said WIlliam Beck esquire against the goods and chattles, Lands, and tenements of the said Defendents, for the said Judgement and Costs, and the said Execution being Delivered to Daniel Glisson a Constable to Execute, he did make Return thereof to the County Court at Feby. Term 1789, and certyfied thereon that pursuant to the said Execution to him Directed, he had lived on a peice of Land in Poley Bridge Branch the property of the said Edward Cornwallis Debruhl in the possession of John Whitehead on 13th day of July 1789, you are therefore commanded to expose to sale the said peice of Land the property of Edward Cornwallis Debruhl in the possession of John Whitehead and have you the said monies before the Justices of the said County Court on the third monday of October next then and there to Render to the said Bryan Whitfield and Needham Whitfield their Damages and Costs and charges aforesaid, together with your own fees for this service hereon fail not and have you then and there this Writ. Witness William Dickson Clerk of the said Court at Duplin this 23d day of July in the 14th year of Independence Anno Domini 1789 By virtue of which said Writ the said Sheriff did enter upon and take possession of the aforesaid peice of Land & lived upon by the Constable aforesaid on the Poley Bridge Branch in the said County of Duplin including the Improvements where John Whitehead then lived and Begining at a gum in the Poley Branch Debruhls corner runing thence So. 35 Wt. 110 pole to a Black jack his corner thence No. 35 Wt. 82 to a Lightwood Stump thence So. 35 Wt. 60 poles to a pine, thence So. 55 Et. 240 pole to a Blackjack thence No. 35 Et. 180 poles to a pine by a branch, thence No. 55 Wt. 160 pole thence to the Begining, containing two Hundred acres which being advertised according to Law did expose the same for sale at Publick vandue on the twelth day of October in the year of our Lord one thousand seven Hundred and Eighty nine, and the said John Whitehead appearing on the premises on the day aforesaid did bid off the said Tract of Land at the sum of nine pounds one shilling current money and was the last and highest Bidder. Now this Indenture Witnesseth that the said James Pearsall sheriff of Duplin County by virtue of and in pursuance of his said office and the writ aforesaid and for and In consideration of the sum of nine pounds one shilling to the said James Pearsall in hand paid befor the sealing and Delivery of these presents the Receipt whereof the said James Pearsall doth hereby acknowledge hath Bargained granted, sold, aliened, Enfeoffed, assigned, set over, conveyed and confirmed by virtue of his said office and In pursuance of the writ aforesaid as fully as he can and is hereby empowered and Enabled, Doth by these presents, grant Bargain and sell alien Enfeofe transfer assign, set over, convey, and confirm unto the said John Whitehead all the aforesaid Tract or peice of Land situate and being as before mentioned, with all the woods waters profits and advantages, whatsoever to the said two Hundred acres of Land and of every part and parcel thereof belonging, and all the Estate, Right Title Interest, claim or Demands of the said Edward Cornwallis Debruhl therein, To have and to hold the said Tract of Land mentioned or Intened to be granted, sold, aliened, transfered, set over, assigned, conveyed, and confirmed unto the said John Whitehead his heirs and assigns forever to the only proper use benefit and behoofe of the said John Whitehead his heirs and assigns forever in as full and ample a manner as he the said James Pearsall sheriff of Duplin County aforesaid by virtue of his office of sheriff and in Execution of the writ aforesaid and is hereby enabled to convey after transfer and change the same and the said James Pearsall doth covenant promise and agree to and with the said John Whitehead his heirs and assigns that the said James Pearsall Sheriff of Duplin County aforesaid will warrant and Defend the said Granted and Bargained premises unto the said John Whitehead his heirs and assigns against the said James Pearsall and his heirs against every other person or persons claiming under him the said James Pearsall his heirs or assigns, so far as he is empowered and enabled by virtue of his said office of sheriff and in pursuance of the act of Assembly in such cas made and provided. In Witness whereof the said James Pearsall hath hereunto set his hand and seal the day and year above written. signed sealed and Delivered In presence of James Pearsall Stephen Jones George Jernagan Hodum State of No. Carolina Duplin County July Term 1791 Then was the within Deed proved in open Court by the oath of Stephen Jones and ordered to be Registered.
