James Pearsall To John Boney
Deed for 200 acres lands
This indenture made the eighteenth day of January in the tenth year of the American
Independance & in the year of our Lord one thousand seven hundred and eighty six. Between
James Pearsall Esquire Sheriff of the County of Duplin in the State of North Carolina of the
one part & John Boney of the same place ont the other part whereas by a writ of Fien Facias
issued from the County Court of Duplin in the following woods to wit, State of North Carolina
To the Sheriff of Duplin County, Greeting, You are hereby commanded that of the goods & chattels
lands & tenements of Henry Gilman late of Duplin County Schoolmaster if to be found in your
Bailiwick you cause to be made the sum of seventy five pounds current money which lately in
the County Court of Peas & Quarter Sessions at Duplin John Boney recovered against him for debt
& also the sum of four pounds one shilling & nine pence for cost and damages in the said writ
expended whereof the said Henry Gilman is convicted & liable as appears of recore & have you
the said moneys before the justices of the County Court of Pleas & Quarter Sessions to be held
for the County of Duplin at Duplin on the third monday of October next then and there to render
to the said John Boney his damages cost & charges aforesaid, together with your own fees for
the service, herein fail not and have you then and there this writing. Witness William Dickson
Clerk of the said Court at Duplin the 23rd day of July in the ninth year of American Independance,
Anno Dom. 1784. By virtue of which said writ the Sheriff did enter upon and take possession of
a certain tract of land situate lying & being in the County of Duplin aforesaid on the south
side of Maxwell swamp opposite and above the mouth of Stockinghead swamp and joining below said
Boney's plantation it being the upper half of a tract of land formerly granted by patent to
Henry Gilman and is bounded as follows to wit. Begining at a water oak & gum Richard Chasson's
corner on the north side of Maxwell swamp, thence crossing the swamp So. 10 Et. 168 poles to a
pine the corner of the paten line South 40 poles to a stake, thence the paten line So. 65 Wt.
140 poles to a pine, thence crossing the swamp No. 25 Wt. 180 poles to a pine the corner, thence
No. 60 Et. to the begining, and the said James Pearsall Esquire Sheriff of Duplin County
aforesaid, did according to law advertise & expose the same to sake on the seventeenth day of
October 1784, & the said John Boney being then & there present upon the premises on the said
seventheenth day of October aforesaid did bid off the said tract of land at the sum of ten
pounds specie & was the last and highest bidder. Now this indenture witnesseth that the said
James Pearsall Sheriff of Duplin County aforesaid by virtue of & in pursuance of his siad office
& the writ aforesaid & for & in consideration of the said sum of ten pounds specie to him the
said James Pearsall in hand paid before the sealing & delivery of these presents, by the said
John Boney the receipt whereof the said James Pearsall doth hereby acknowledge, hath granted
bargained sold aliened enfeoffed conveyed confirmed assigned & set over by virtue of his said
office & in pursuance of the writ aforesaid as fully as he can and is thereby empowered &
enabled, doth by these presents grant bargain sell alien enfelffe transfer convey confirm
assign & set over unto the said John Boney all the aforesaid tract of land containing two
hundred acres, situate lying & being & before mentioned with all the woods waters ways profits
& advantages whatsoever to the said two hundred acres & of every part and parcel thereof
belonginig or in any wise appertaining & all the estate right & title interest, claim demand
of the same James Pearsall therein. To have & to hold the said tract of land herein mentioned
or intended to be sold aliend transfered assigned set over conveyed & confirmed unto the said
John Boney his heirs and assigns forever to the only proper use & behoofe of the said John
Boney his heirs and assigns forever, in as full and ample manner as he the said James Pearsall
Sheriff of Duplin County aforesaid by virtue of his said office of Sheriff & in execution of
the writ aforesaid & is hereby enabled to convey transfer & change the same & the said James
Pearsall doth covenant promise and agree to & with the said John Boney his heirs & assigns,
that the said James Pearsall Sheriff of Duplin County aforesaid, will warrant and defend the
said granted & bargained premises unto the said John Boney his heirs and assigns against the
said James Pearsall & his heirs & against all & every other person or persons claiming under
him the said James Pearsall his heirs or assigns so far as he is empowered & enabled by virtue
of his said office of Sheriff & in pursuance of the writ aforesaid & of the act of Assembly in
such case made and provided. In witness whereof the said James Pearsall hath hereunto set his
hand & seal the day and date first above written.
