James Pearsall & wife To James James
Deed for 45 acres lands
This indenture made this nineteenth day of July in the year of our Lord one thousand seven
hundred and eighty five and in the tenth year of American Independance, between James Pearsall
Esqr. of the one part and James James planter of the other part, both in the County of Duplin &
State of North Carolina Witnesseth, that whereas by patent granted to the said James Pearsall
bearing date the tenth day of November in the year of our Lord one thousand seven hundred and
eighty four, twenty acres part & parcel of the aforementioned patent land was granted unto the
said James James by the said James Pearsall, said land lying and being in the County and State
aforesaid and is bounded as follows Viz. on the west side of the No. East branch of Cape Fear
River and No. side of Maxwell swamp on the head of Elder Branch, Begining at a pine Roberty
Dickson's corner on John McCulloh's line, thence along his line North 75 Wt. 140 poles to a
pine, thence, South 25 Et. 62 poles to a stake, Robert Dickson's corner, thence Robert Dickson's
line North seventy two East 100 poles to the first station, as also one other tract piece or
parcel of land which was in like manner granted unto the said James Pearsall by patent bearing
date the first day of July in the year of our Lord one thousand seven hundred & seventy nine
twenty five acres of land was granted unto the aforesaid James James by the said James Pearsall
the aforesaid land lying in the County and State aforesaid bounded as follows Viz. on the South
side of the Grove Swamp and the So. side of pasture branch. Begining at a pine his the said
James Pearsall's own line, thence along his said line No. 27 Wt. 104 poles to a pine, eight
poles from Robert Miller's corner, thence to & with Robert Miller's line South ten West 48 poles
to a pine, thence So. 37 Et. 104 poles to a pine on John McCulloch's line by Robert Clugston's
line, thence McCulloch's line to the begining. Now this indenture witnesseth that the said
James Pearsall for and in consideration of the sum of twenty pounds currency of the State
aforesaid as also the further sum of twenty five pounds line money of the State aforesaid to
him in hand paid by the said James James the receipt whereof he doth hereby acknowledge hath
granted bargained sold and by these presents doth grant bargin and sell unto him the said James
James the aforesaid two tracts pieces or parcels of land with their appurtenances to him the
said James James his heirs and assigns forever. To have and to hold the aforesaid twenty acres
of land, together with the said twenty five acres of land with their appurtenances to him the
said James James his heirs free and clear of all manner of incumbrances of what nature or kind
soever that might in any wise obstruct or make void this present deed, and I the said James
Pearsall for muself and my heirs do by these presents warrent secure & defend the aforesaid two
tracts of land with their appurtenances and to him the said James James his heirs & assigns,
and Zilpha Pearsal wife of the said James Pearsall doth by these presents yield up and surrender
all her right & title of dower and power of thiers of in and into the aforaesaid land and
premises with the appurtenances. In witness whereof the aforesaid James Pearsall and Zilpha
his wife have hereunto set their hands & seals the day & year first written.
