(Transcribed by Joan S Dunn) Deed Book E Page 111, 112, 113, & 114 James Pearsall Sheriff To Edward Armstrong Deed 84 acres This Indenture made the twenty second day of January In the Fourteenth year of the American Independence and in the of our Lord One thousand seven hundred and Eighty nine. Between James Pearsall esquire High Sheriff of the County of Duplin in the state of North Carolina of the one part and Edward Armstrong of the same place of the other part. Whereas the states writ of Fieri Faceras issuing from the County Court of pleas and Quarter Sessions for the County of Duplin in the following words to wit; State of North Carolina To the Sheriff of Duplin County Greeting. You are hereby commanded as was commanded before, that of the goods and chattles Lands and tenements of John Armstrong if to be found in you Bailiwick you cause to be made the sum of Eleven pounds ten shillings which lately in the County Court of pleas and quarter sessions at Duplin Edward Armstrong recovered against him for his damages is the suit which he there prosecuted against the said defendent, and a loss the sum of four pounds six shillings and four pence for costs and charges in the said suit expended, whereof the said John Armstrong is convicted and liable and appears to us of Record and have you the said moneys before the justices of the said County Court on the third monday of July next then and there to render to the said Edward Armstrong his damages and costs and charges aforesaid together with your own fees for this service therein fail not and have you then and there, this writ Witness William Dickson Clerk of the said Court at Duplin the 22nd day of April in the 10th year of Independence Anno Domino one thousand seven hundred and Eighty nine. By virtue of which said writ, the said Sheriff did Enter upon and take possession of a certain Tract or parcel of Land situate lying and being in the County of Duplin aforesaid West side of the North Et. River in the for hand on the heads of Maxwell Branches. Begining at a pine West side of a Drain of the Little Marsh Joseph Dicksons corner, thence Dicksons line No. 55 Et. 90 poles to a white oak said Armstrongs corner, thence his own line South 75 Et. 70 poles to a water oak his corner in the swamp, thence his other line So. 15 Wt. 127 poles to a pine the Corner of a survey called Nowland survey, thence the line or near it of a survey called the Little Marsh survey No. 65 Wt. 104 poles to a water oak in the Little Marsh branch, thence up the marsh to the place of begining. It being the Contents of a Patent for Eighty four acres of Land Granted to John Armstrong aforesaid the Eleventh day of July 1788. Which said tract of Land the said sheriff did advertise according to law and expose the same for sale at publick vandue on the Eleventh day of June 1789, and the said Edward Armstrong appearring upon the premises on the day aforesaid did bid off the said Tract of Land containing Eighty four acres, be the same more or less at the sum of five pound two shillings six pence. Now this Indenture Witnesseth that the said James Pearsall Sheriff of Duplin County. By virtue of and in pursuance of his said office and the writ aforesaid and for and in consideration of the said sum of Five pounds two shillings and six pence, to the said James Pearsall In hand paid before the sealing & Delivery of these presents, the Receipt whereof the said James Pearsall doth hereby acknowledge, Hath granted assigned set over conveyed and confirmed by virtue of his said office, and in pursuance of the writ aforesaid, as fully as he can and is hereby empowered and enabled, Doth by these presents grant bargain and sell alien Enfeoffe transfer assign and set over convey and confirm unto the said Edward Armstrong the aforesaid Tract or parcel of Land with all the woods, waters profits and advantages to the said Eighty four acres of Land & and the estate right title Interest property and Demand of the said John Armstrong or of the heirs of the said John Armstrong. To have and to hold the aforesaid Land to him the said Edward Armstrong his heirs and assigns forever, and in as full & ample manner as he the said James Pearsall sheriff of Duplin County aforesaid by virtue of his said office and the writ aforesaid and is hereby enabled to convey alter transfer and change the same and in pursuance of the Act of Assembly in such case made and provided. In witness whereof the said James Pearsall hath hereunto set his hand & seal the day and year first above written. signed sealed and Delivered James Pearsall in the presence of us Alexander Dickson Holdon McGee State of No. Carolina Duplin County January Term 1791 Then was the within Deed acknowledged in open Court and ordered to be Registered.
