James Pearsall & Wife To David Murdoch
Deed Sundry Tracts of Land
North Carolina
This Indenture made this sixteenth day of July in the sixteenth year of American
Independance & in the year of our Lord One Thousand seven Hundred and ninety one. Between
James Pearsall & Zilpha his wife of the County of Duplin & State of North Carolina afore
said of the one part and David Murdoch of the same County and state of the other part
Witnesseth, that the said James Pearsall for and in consideration of the sum of one Thousand
pounds current money of said State to him in hand well and Truly paid, before the Ensealing
and Delivery of these presents by the said David Murdoch, the receipt whereof he doth hereby
acknowledge and himself to be therewith fully satisfied, contented and paid, Hath given
granted, bargained sold enfeoffed conveyed confirmed assigned and set over unto the said
David Murdoch his heirs and assigns forever Three Tracts or parcel of Land, Two of which were
formerly the property of William Floyd by Virtue of a Deed from Henry Eustace McCulloh, which
said Two Tracts or parcels of Land were seized by Felix Kenan high sheriff of Duplin County
aforesaid by virtue of a writ of fieri Facerras to him Directed, from the superior Court of
WIlmington District, and by him sold to Thomas Routledge agreeable to Law which by Deed from
the said Felix Kenan as Sheriff aforesaid to said Thomas Routledge, bearing date 20th July
ADomini 1773 may more fully appear and afterwards conveyed by the said Thomas Routledge to
James James by Deed Bearing date the 13th October 1773 which by said Deed may more fully
appear and by James James to James Pearsall aforesaid by Deed bearing Date the 7th day of
December ADOmini 1778 which by said Deed may more fully appear which messuage Tract or parcels
of Land, lying and being in the County aforesaid the said James Pearsall doth hereby sell
convey and confirm to the said David Murdoch, his heirs and assigns forever (Viz) one Tract
containing Three Hundred and thirty acres (the Court House Lott being excepted and Deducted)
lying on the south side of Grove swamp begining at an ashe Thomas Routledges corner, on or near
the Run of the swamp, Runing thence down the Dividing line So. 5 Et. 260 pole to a white oak
on the mill branch thence No. 55 Wt. 70 pole to a Red oake thence No. 78 Wt. 86 pole to a pine
thence Wt. 114 poles crossing the head of pasture branch, to a black oak thence No. 8 Wt. 192
poles to a water oak on or near the run of the swamp, thence down the various courses to the
begining. One other Tract of Land joining and opposite to the aforesaid Tract on the north
side of Grove swamp, containing by survey one Hundred and twenty Three acres Begining at an
ashe at the Run of the swamp a corner of Obediah Evanses Tract thence Runing as his line No.
86 poles to a pine, thence Wt. 184 poles to black oak, thence So. down a Branch 76 pole to a
black oak thence Down the swamp So. 36 Et. 60 pole to a water oak on the Run of the Grove Swamp
thence Down the various courses thereof to the first station also one other Tract or parcel of
Land, adjoining the first described above containing Three Hundred and ten acres on the south
side of the Grove swamp, including the Indian Grave on the main Road, Begining at a pine, Mary
McCullohs corner on William Fredricks line, and Runs So. 80 WT. 28 pole a white oak and pine her
other corner, thence along her other line No. 35 Wt. 190 poles to a pine, at Isaac Hunters line
thence north 35 Et. 132 poles to a pine on his line at the Road thence along said Hunters line
Et. 170 poles to a pine at said Jameses Corner, thence along his other line, So. 53 Wt. 70 poles
to a white oak, his corner in the mill swamp, thence up the swamp with William Fredricks line to
the Begining Being the contents of a Patent granted to James James the 28th of Febuary one thousand
seven and seventy five and him conveyest to the said James Pearsall, by Deed bearing date the
first day of January ADomini 1779 which by said Deed may more fully appear, which said three
tracts or parcils of Land, contain by Estimation, seven Hundred and sixty three acres, be the
same more or Less. To have and to hold the said Bargained Land and premises with the appurtainances
thereunto belonging to him the said David Murcoch his heirs and assigns forever In as full ample
a manner as he the said James Pearsall by his Deed from James James, could or might have enjoyed
with the least lett hindrance or molistation of him the said James Pearsall his heirs and assigns,
and that free and clear freely and clearly, acquited of and from all manner of former gifts grants
bargains sales leases wills mortgages intails jointers judgements Dowers Executions Extents or
troubles of any kind whatsoever Had made done or commited by him the said James Pearsall his heirs
or assigns and the said James Pearsall and Zilpha his wife doth further covenant and engage to
warrant and Defend to the said David Murdoch his heirs and assigns, the quit and peaceable possession
of above said Land and premises, from and against the Lawfull claim and demand of any person or
persons whatsoever.
