James Outlaw to Lewis Barnes Deed 25 September 1777

Deed Book 5, pp351-2) James Outlaw to Lewis Barnes 100 State of North Carolina Duplin County This Indenture made this twenty Fifth day of September in the Year of Our lord Christ One thousand Seven hundred and Seventy Seven Between James Outlaw Planter of the One part and Lewis Barnes of the same County and province aforesaid of the Other Part. Witnesseth that the said James Outlaw for and in consideration of the sum of One Hundred and forty Four pounds proclamation money to me in hand paid the Receipt whereof I do hereby acknowledge myself therewith fully satisfied and content and of every part and parcel thereof and hereby acquit Exonerate and Discharge him the said Lewis Barnes his heirs Executors administrators or Assigns forever and Have Given granted Bargained sell and confirm Unto the said Lewis Barnes his heirs and assigns forever a parcel of land Containing one Hundred acres lying and Being in the County of Duplin in the province aforesaid On the East side of the North East Swamp and North side of Burn Coat Beginning at a Spanish Oak above the mouth of Prescoat’s Branch and Runs thence North 5 East 130 pole to a pine thence North 40 West 130 pole to a pine thence South 50 West 120 pole to a Black Jack near Robert Burnley’s line thence to the Beginning the said land taken and Pattented By Joseph Sutton Pattent Bearing date the sixteenth day of April One Thousand Seven hundred and Seventy Five and by the said James Outlaw set over to the said Lewis Barnes To Have and to Hold unto the said Lewis Barnes his heirs and assigns forever With all the appurtenances priviledges Commodities to the same Belonging or in any wise appurtaining and I the said James Outlaw Hath a good and Rightfull power and authority to sell convey and confirm the above Bargained premises Unto the above Named Lewis Barns in manner and Form aforesaid and By these presents will Warrant the said premises so Bargained & sold free from all Claim or Demands of the said James Outlaw or my heirs or assigns or any other person or persons Whatsoever laying any lawfull Claim on any part or parcel thereof and that the said lands now are and shall forever Remain Continue and be unto the said Lewis Barnes his heirs and assigns forever issue and Clearly acquited Exonerated and Discharged of and from all manner or former and other Gifts grants sails leases Wills Dowers entails conveyances Mortgages Bonds Judgements Rents and Arrearages of Rents and all other encumbrances Whatsoever But that the said Lewis Barnes his heirs and assigns shall at all times hereafter peaceably Have Hold Occupy and Injoy the said lands and premises without any hindrance of him the said James Outlaw his heirs Executors administrators or assigns or any other person or persons laying any lawfull Claim thereunto or any part or parcel thereof and I the said James Outlaw for myself my heirs Executors administrators or assigns do by these Presents Covenant and agree to and with the said Lewis Barnes his heirs and assigns to make a better title insurance and give another deed if this should not Be Deemed lawfull and I the said James Outlaw Do Warrant and Defend the same free and Clear of Incumbrances Whatsoever the said Lewis Barnes paying the Quit Rents as in the Pattent is Reserved (Continued) Page 352.
