Deed Book 5, pp258-9) James Outlaw to Lewis Barnes For 180 acres State of North Carolina Duplin County This Indenture made this Fifth day of September in the Year of our lord Christ One Thousand seven hundred and seventy seven Between James Outlaw Planter of the one part and Lewis Barnes of the said County and province aforesaid of the other part Witnesseth that the said James Outlaw do for and in consideration of the sum of Five pounds proclamation money to me in had paid the Receipt whereof I do hereby acknowledge my self herewith being satisfied and contented and I convey part and parcel thereof doth hereby acquit Exonerate and discharge him the said Lewis Barnes his heirs Executors administrators and assigns forever and have given granted Bargained sold and By these presents doth fully and Absolutely give grant Bargain sell and confirm Unto the said Lewis Barnes His Heirs and assigns Forever a parcel Of land Containing One hundred and Eighty acres of land lying and Being in the County of Duplin and province aforesaid of North Carolina On the East side of the North East River on the North side of Burn Coat Swamp. Beginning at a Black gum in the swamp at Prescoats Branch about twenty pole above the mouth of its Run thence to and along Joseph Suttons line North 30 East 144 pole to a pine his corner thence along his other line North 40 West 100 pole to a Black jack Gum at the Run of Burn Coat swamp thence up the branch to the Beginning the said land taken an Pattented By James Outlaw Pattent Being date the Twenty second day of July one thousand seven hundred and seventy four and by the and James Outlaw Set over to the said Lewis Barnes To Have and to Hold Unto the said Lewis Barns his heirs and assigns forever with all the appurtenances priviledges Commodities to the same Belonging or in any wise appertaining and I the said James Outlaw Hath a good and Rightfull power and authority to sell convey and confirm the above Bargained premises Unto the above named Lewis Barns in manner and form as aforesaid and By these presents doth warrant the said premises so bargained and sold for from all Claims and demands of the said James Outlaw or My Heirs or assigns or any other person or persons Whatsoever laying any lawful Claim or any part or parcel Thereof and that the said land and premises Now are and shall forever Remain continue and be unto the said Lewis Barns his heirs and assigns forever truly and Clearly acquited Exonerated and discharged of and from all manner of former and other gifts grants sails leases Will dower entails conveyances Mortgages Bonds Judgments Rents and Rears of Rents and all other incumbrances Whatsoever but he the said Lewis barns his heirs and assigns shall at all times hereafter peaceably Have Hold Occupy and enjoy the said land and premises without any Hindrance of him the said James Outlaw his heirs Executors administrators or assigns or any other person or persons laying any lawfull Claim thereto or any part or parcel thereof and I the said James Outlaw for my heirs Executors administrators or assigns as By these presents covenant and agree to and warrant the said Page 259.
