James Moore To Thomas Hill Deed 3 March 1785

(Transcribed by Joan S Dunn) Deed Book 1 A Page 112, 113, & 114 James Moore To Thomas Hill Deed for 98 acres lands This indenture made the third day of March in the ninth year of the American Independance, and in the year of our Lord one thousand seven hundred & eighty five between James Moore of the County of Duplin in the State of No. Carolina of the one part and Thomas Hill of the same place on the other part. Witnesseth, that the said James Moore for & in consideration of the sum of one hundred and twenty five pounds current money of the State of North Carolina to him in hand well and truly paid by the said Thomas Hill the receipt whereof he doth hereby acknowledge and himself therewith to be fully satisfied eontented and paid and of every part & parcel thereof, doth hereby acquit and discharge the said Thomas Hill his heirs executors and administrators forever, by these presents aliened and confirmed and by these presents dot grant bargain sell alien and confirm unto the said Thomas Hill & his heirs a certain piece or parcel of land situate lying & being in the County of Duplin aforesaid, and is bounded as follows (to wit.). Begining at a gum & white oak on the run of Bear swamp the dividing corner between the said James Moore & John Moore and runs along the dividing line So. 40 Et. 236 pole to a live oak in a pond, thence along the back line So. 35 Wt. 48 poles to a water oak & a maple in the Spring branch, thence down the Spring branch as the run meanders to a white oak at the mouth thereof on the run of Bear Swamp, thence down the said run of Bear Swamp as it meanders to the begining, and containing in the whole ninety eight acres of land, be the same more or less, it being part of a tract of land which was formerly sold and conveyed by a deed of bargain & sale from Henry Eustact McCulloch to John Moore and since by the last will & testament of the said John Moore become the properity of the said James Moore and has been subdivided and laid off for him agreeable to the will of the said John Moore in the manner and form as here before discribed and now by these presents conveyed by the said James Moore to the said Thomas Hill in manner and form as aforesaid. To have and to hold to him the said Thomas Hill his heirs and assigns forever, all and singular the said ninety eight acres of land together with all woods waters and water courses houses buildings proffits commoditied hereditaments and appertenances whatsoever to the said premises hereby granted or any part thereof beloning or in any wise appertaining and the reversion & reversions remainder & remainders rents issues and profits thereof and also all the estate right title interest use trust property claim and demand whatsoever of him the said James Moore of in and to the said premises and all deeds evidences & writings touchind or in any wise concerning the same, and the said James Moore for himself his heirs executors and administrators doth covenant promise & grant to & with the said Thomas Hill his heirs and assigns by these presents that the said James Moore now at the time of sealing & delivering of these presents is seized of a good and perfict & in defeaseable estate of inheritance in fee simple of and in the premises hereby bargained & sold and that he has good power and lawfull and alsolute authority to grant and convey the same to the said Thomas Hill in manner and form aforesaid, and that the said premises now are and so forever hereafter shall remain and be free & clear of & from all former gifts grants bargains sales dower right & title of dower judgements executions titles troubles charges & incumbrances wharwoever made done committted or suffered by the said James Moore or any other person or persons whatsoever, the rents and taxes thereare now due and hereafter to become due & payable to the State (only excepted) and fore prized & that the said James Moore and his heirs all and singula the premises hereby bargained & sold with the appertenances unto the said Thomas Hill his heirs & assigns against him the said James Moore and his heirs & all and every person or persons whatsoever, shall warrent and forever defend by these presents. In witness whereof the said James Moore hath hereunto set his hand & seal the day and year first above written. James Moore Signed sealed & delivered in presence of us W. Dickson Tho.
