To Robert Dickson Deed 150 acres This Indenture made the nineteenth day of January in the Eleventh year of American Independence and in the year of our Lord 1787. Between James Kenan esquire High sheriff of the County of Duplin in the state of North Carolina of the one part and Robert Dickson of the same place on the other part. Witnesseth, that whereas by the states writ of Fieri Faceras issuing from the Clerks office of the County Court of Duplin in the following words to wit State of North Carolina to the Sheriff of Duplin County Greeting. You are here by commanded that of the good and chattles Land and tenements of William Allen Henry Jones and Ezekiel Allen if to be found in your Bailiwick, you cause to be made the sum of twenty nine pounds seven shillings and Eleven pence which lately in the County Court of pleas and Quarter Sessions at Duplin in the states administrator of Philip Rouse Deceased Recovered against him for Debt and also the sum of three pounds ten shillings for Costs and Charges in the said suit Expended whereof the said William Allen Henry Jones and Ezekiel Allen convicted and liable as appears to us of Record and have you the said monies before the Justices of the said County Court to be held for the said County of Duplin in the third monday of July next then and there to render to the said Arthur Stokes his Damages and Costs aforesaid together with your own fees for this Service herein it is not and have you then and there this writ ex. by virtue of which said writ. the said sheriff did Enter upon and take into his possession a certain Tract of Land the property of Henry Jones, (but possessed by Ezekiel Allen) on the North side of Island Creek on the head of the Mile branch, in the said County of Duplin. Begining at a pine thence running Wt. 182 poles to a lightwood tree, thence South 136 poles to a white oak thence Et. 174 poles to a pine on William Allens line thence to the first station, containing one Hundred and fifty acres, and having the said Lands advertised according to law did expose the same for sale at Publick vandue on the fifteenth day of September in the year of our Lord 1786 and the said Robert Dickson appearing on the premises on the said fifteenth day of September did bid off the said tract of Land at the sum of five pound Currint money and was the Last and highest bider. Now this Indenture witnesseth that the said James Kenan Sheriff of Duplin County by virtue of and in pursuance of his said office and the Writ aforesaid and for an in consideration of the sum of five pounds to the said James Kenan in hand paid before the sealing and Delivery of these presents the Receipt whereof the said James Kenan doth hereby acknowldege hath granted, bargained, sold, aliened enfeoffed, assigned, set over, conveyed, and confirmed, by virtue of his said office, and in pursuance of the writ aforesad as full as he can an did thereby empowered and enabled, Doth by these presents, grant, bargain, and sell alien enfeoffe, transfer, assign, set over, convey and confirm unto the said Robert Dickson all the aforesaid Tract of Land situate lying and being as before Mentioned, with all the woods, waters, profits, and advantages whatsoever to the one hundred and fifty acres of Land belonging and every part and parcel thereof, and all the Estate Right, Title, Interest, claim or Demand of the said Henry Jones or Ezekiel Allen thereon, To have and to hold the said Tract of Land, mentioned or intended to Granted, sold, aliened, transfered, set over, assigned, conveyed, and confirmed unto the said Robert Dickson his heirs and assigns forever to the only proper use, benefit and behoofe, of the said Robert Dickson his heirs and assigns forever, in as full and ample a manner as he the said James Kenan Sheriff of Duplin County aforesaid by virtue of his said office of sheriff and in Execution of the writ aforesaid and hereby enabled to convey alter, transfer, and change the same and the said James Kenan doth covenant promise and agree to and with the said Robert Dickson his heirs and assigns that the said James Kenan Sheriff of Duplin County aforesaid will warrant & Defend the said granted and bargained premises unto the said Robert Dickson his heirs and assigns against the said James Kenan and his heirs against every other person or persons claiming under him the said James Kenan his heirs or assigns so fas as he is empowered & enabled by virtue of his said office of Sheriff and in pursuance of Assembly in such case made & provided. In witness whereof I the said James Kenan hath hereunto set my hand and seal the day and Date first above written. Signed sealed and Delivered James Kenan Sheriff in the presence of Joseph Dickson John Dickson State of No. Carolina Duplin County January Term 1791 Then was the within Deed acknowledged in open Court and ordered to be Registered.
