(Transcribed by Joan S Dunn) Deed Book 1 A Page 121 & 122 James Kenan To Andrew Thally Deed for 640 acres lands This indenture made the eighth day of January in the year of our Lord Chirst, one thousand seven hundred and eighty five & in the ninth year of American Independance, between James Kenan esquire of the County of Duplin and State of North Carolina of the one part & Andrew Thally of the County and State aforesaid of the other part. Witnesseth that the said James Kenan for and in consideration of the sum of eighty pounds specie currancy of North Carolina to him in hand paid or secured to be paid, the receipt whereof is hereby acknowledged and therewith fully satisfied contented & paid & of every part & parcel thereof doth exonorate acquit & discharge the said Andrew Thally his heirs and assigns forever, one tract of parcel of land situate lying and being in the County of Duplin & State of North Carolina aforesaid containing by estimation six hundred and forty acres of land, be the same more or less, lying on the west side of the North East branch of the Cape Fear river & is on both sides of Maxwell swamp & of the road from Soractee to the Welch Tract. Begining at a white oak on the South Et. side of the swamp, about 220 poles above the road, running thence So. 30 Et. 240 poles to the center of three pines, thence No. 60 Et. 320 poles to a pine, thence No. 30 Wt. 320 poles to a pine about 180 poles over the swamp below the road, thence So. 60 Wt. thre pole to a pine on the same side of the swamp & about the same distance from it thence So. 30 Et. 80 pole across the swamp to the first station. Being the contents of a patent granted to Eager Allen Esqr. deceased bearomg date the eight day of June one thousand seven hundred and thirty nine, and conveyed by the executors of Mrs. Sarah Allen late of New Hanover County deceased to John Thally & from John Thally to the aforesaid James Kenan, reference being had to the aforesaid deed dated the 23rd day of Februy in the year of our Lord 1763 being the date of the conveyance from the executor of Mrs. Allen to John Thally, reference also being had to the deed from John Thally to the said James Kenan bearing date 18th day of June in the year of our Lord Christ 1770, may more fully and largely appear etc. To have and to hold the said land & premises with all the appertenances to the same belonging or in any wise appertaining to him the said Andrew Thally his heirs and assigns forever, and the said James Kenan the above bargained land and premises shall and warrant & forever defend to him the said Andrew Thally his heirs & assigns forever from & against him the said James Kenan his heirs & assigns as also from and against the just and lawful claim of every other person or persons whatsoever who may hereafter lay any lawfull claim to the same. In witness whereof the said James Kenan has hereunto set his hand & seal the day & date above written. James Kenan Signed sealed & delivered in the presence of us Wm.
