James Kenan Sheriff to William Hunter
Deed for 257 acres lands
This Indenture made the nineteenth day of July in the eleventh year of the American
Independence, & in the year of our Lord one thousand seven hundred & eighty seven, Between
James Kenan Esqr. High Sheriff of the County of Duplin in the State of No Carolina of the one
part and William Hunter of the same place of the other part, whereas the states writ of Fieri
Facias issuing from the County Court of Duplin in the following words, to wit, State of No
Carolina. To the Sheriff of Duplin County Greeting. We command you that of the goods & chattels
lands & tenements of Jesse Jernigan planter, if to be found in your Bailywick you cause to be
made the sum of fifty

six pounds five shillings & three pence, which lately in our County Court of Pleas & Quarter
Sessions held for Duplin County at the Court House in Duplin, was adjudged to Thomas Jernigan
for his damages, and also the sum of three pounds eleven shillings & nine pence for cost and
charges in the said suit expended, whereof the said Jesse Jernigan is convicted & liable as
appears to us of record & hand you the said monies besides your fees for this service, before
our said Court at Duplin on the third monday of April next, then & there to render to the said
Court the damages & costs & charges aforesaid – Herein fail not & hand you then & there this
writ &c. Witness Wm Dickson Clerk of the said Court at Duplin the nineteenth day of January i
n the eleventh year of the american Independence Anno. Dom. 1787 By virute of which said writ
the said Sheriff did enter upon and take possession of two certain small tracts or parcels of
land on the North side of the Grove swamp on ash Branch, in said County of Duplin To wit, one
tract or parcel of land lying on both sides of Ashe Branch, Beginning at a Bunch of ash trees
growing out of an old stump by the grove run, lower side of ash Branch, thence the old line
about No 3 Wt 178 poles to a white oak in a little Branch Hunter’s lower corner, formerly
Holten’s corner, thence down said Branch 70 poles to the mouth at ash Branch run, thence up
said run to Samuel Boyet’s corner about 20 poles up, thence Boyet’s line So 75 Wt 42 pole to a
pine his corner, thence his other line So 22 Et 72 pole to a pine his corner, thence John
Phillipse’s line So 110 pole to a white oak at the Grove run, & down the same to the begining,
containing in the whole one hundred & two acres of land, The other tract or parcel of land
begining at a pine William Hunter’s corner, formerly Abraham Molten’s by a little dreaw of
ash Branch thence No 87 Et 144 poles crossing the main road to a pine, thence So 3 Et crossing
said road a second time 166 pole to a pine, thence So 86 Wt 158 poles

to a pine by Hunter’s lower corner w. oak, thence along Hunters’ line to the begining, &
containing one hundred and fifty acres of land, which said two tracts or parcels of land being
the property of the said Jesse Jernigan & containing in the whole two hundred and fifty seven
acres the said Sheriff having entered upon and taken possession of the same, did according to
law advertise the same and expose the same for sale at publick vendue on the third day of March
in the year of our Lord 1787, and the said William Hunter appearing on the premises on the day
aforesaid did bid off the sd two tracts of land containing in the whole two hundred & fifty
seven acres for the sum of ten pounds ten shillings, and was the last and highest bidder – Now
this Indenture witnesseth that the said James Kenan Sheriff of Duplin County aforesaid by
virtue of & in pursuance of his said office and the writ aforesaid & for and in consideration
of the sum of ten pounds ten shillings to the said James Kenan in hand paid before the sealing
& delivery of these presents, the receipt whereof the said James Kenan doth hereby acknowledge,
hath granted bargained sold aliend enfeoffed assigned set over conveyed & confirmed by virtue
of his said office & in pursuance of the writ aforesaid as fully as he can & is thereby
empowered and enabled, doth by these presents grant bargain sell alien enfeoff transfer assign
set over convey & confirm unto the said William Hunter all the aforesaid two tracts or parcels
of land situate lying & being as before mentioned, with all the woods waters profits &
advantages whatsoever to the said two tracts or parcels of land & of every part and parcel
thereof & the estate right telle interest of demand of the said Jesse Jernagan thereon. To have
& to hold the said two tracts or parcels of land containing two hundred and fifty seven acres
mentioned or intended to be granted sold aliend transferred assigned set over conveyed &
confirmed unto the said William Hunter his heirs & assigns forever, the only proper use benefit
& behoof of the said Wm Hunter his heirs & assigns forever, in as full & ample a manner as he
the said James Kenan Sheriff of Duplin county aforesaid by virtue of his said office of Sheriff
& in execution of the writ aforesaid, and is hereby enabled to convey alter transfer & change
the same, & the said James Kenan doth covenant

promise & agree to and with the said Wm Hunter his heirs & assigns that the said James Kenan
Sheriff of Duplin County aforesaid will warrant & defend the said granted & bargained premises
unto the said William Hunter his heirs & assigns against the said James Kenan & his heirs &
assigns all and every other person or persons claiming under him the said James Kenan his heirs
or assigns so far as he is empowered & enabled by virtue of his said office of Sheriff & in
pursuance of the act of assembly in such cases made & provided. In witness whereof the said
James Kenan hath hereunto set his hand & seal the day & year first above written.
