James Kenan & John Hill To Simon Davis Deed 400 acres This Indenture made this Fifty Day of January in the year of our Lord one thousand seven Hundred and eighty nine between James Kenan Esqr. and John Hill both of Duplin County & State of No. Carolina of the one part and Simon Davis of the Same County and State of the other part witnesseth that whereas the said Simon Davis being intitled to Two Tracts of land in Duplin County aforesaid where on the said Simon Davis formerly livid agreed with Felix Kenan late of the said County Deceased to let him have the said Lands of which he was so possessed for Two Tract of Land also in the said County formerly the Property of Francis Brice Deceased who Transfered and sold the same to the said Felix Kenan who died without making a Title of the same to the said Simon Davis as by his said agreement he ought to have Done the said Felix Kenan being possessed of the said Simon Davis's Land & the said Simon David being possess of the said Kenans Lands formerly the property of the said Brice inperformance of the said agreement as aforesaid and whereas also William Kenan Son and Heir at Law of the said Felix Kenan is likewise dead, without making a Title of the said Land to the said Davis pursuant to the agreement of his said Father Felix withe the said Simon David and Whereas likewise the said James Kenan and John Hill who married Two Sisters of the said William Kenan and in Right of such marriages are Heirs at Law of the said William Kenan who Did without Issue and who have also administered upon the Estate of the William Kenan and as Heirs of the said Kenan the proper persons to carry the said agreement between the said Felix Kenan and the said Simon Davis into Execution. Now this Indenture Witnesseth that the said James Kenan and John Hill as Heirs of the said William Kenan and To carry the said agreement into Execution and for the consideration of the said Davis making a Title of the said Two Tracts of Land so agreed by him with the Felix Kenan the Receipt is hereby acknowledged have and each of them hath by these presents granted bargained and sold aliened released and confirmed unto the said Simon Davis his heirs and assigns forever all them Two tracts or parcels of Land adjoining each other in Duplin County aforesaid formerly the property of Francis Brice and by him sold as aforesaid to the said Felix Kenan Deceased whose Heir the said William Kenan was and whose Heirs as aforesaid the said James Kenan and John Hill are and bounded as follows (that is to say) The one Tract containing Two hundred acres Begining at a water Oak and runing thence So. 20 Et. 220 poles to a white oak thence So. 70 Wt. 146 poles to a pine thence No. 20 Wt. 220 poles to the Creek then up the Creed the various courses of the same to the first station the other Two Hundred acres is meared and bouned as follow to wit Begining at a white oak and runing So. 40 Et. 180 poles to a Lightwood Tree thence No. 50 Et. 180 poles to a pine thenc No. 40 Wt. 180 poles to two pines in the said Brices Line and thence to the Begining both surveys containing Four Hundred acres of Land be them more or less as by the patents and Deeds of the said Land Recorded in the proper offices Reference being thereunto had may more fully and at Large appear Together with the reversion & Reversions rents issue and profits of the said Four Hundred acres of Land and every part and parcel thereof to ensure to him the said Simon Davis his Heirs and assigns forever pursuant to the said agreement and the Will and intent of the parties hereto and for no other end intent or purpose whatsoever any thing herein contained to the contrary or seeming to the contrary in any wise not withstanding and we the said James Kenan an John Hill do hereby agree and promise to and with the said Simon Davis his Heirs and assigns to make any other or further conveyances of the said Four Hundred acres of Land with the appurtainances unto the said Simon Davis to Ensure to him his Heirs and assigns forever as by his council Learned in the Law shall be Lawfull & reasonally Devised advised or required for the further and better assuring the said Land and Premises to the said Simon Davis to Ensure to him his heirs and assigns forever pursuant to the agreement aforesaid and the parties thereto and hereto In Witness whereof the said James Kenan and John Hill have hereunto set their hands and affixed their seals the Day and year first before written sealed and Delivered In Presence of James Kenan Admin William Wilkinson John Hill David Bunting State of No. Carolina Duplin County April Term 1791 Then was the within Deed proved in open Court by the oath of William Wilkinson and ordered to be Registered.
