James Hurst To Levin Watkins Deed 21 January 1785

(Transcribed by Joan S Dunn) Deed Book 1 A Page 388, 389, & 390 James Hurst To Levin Watkins Deed for 60 acres lands This indenture made this twenty first day of January in the year one thousand seven hundred & eighty five. Between James Hurst junr. of the County of Duplin State of No. Carolina & Levin Watkins of the County & State aforesaid. Witnesseth that the said James Hurst for and in consideration of the sum of thirty five pounds specie to him in hand paid, the receipt whereof he doth hereby acknowledge, hath given granted bargained and sold, and by these presents doth give grant bargain sell convey & confirm unto the said Levin Watkins his heirs executors administrators & assigns forever, a certain tract or parcel of land sittuate lying & being in the County of Duplin, on the head of Cowhole Branch. Begining at a pine and runing So. 73 Et. 29 pole to a pine, thence So. 17 Wt. 84 pole to an oak, thence So. 55 Wt. 90 pole to a pine, thence 6 pole to a gum in the said Cowhole Branch, thence up the various courses of said Branch to the begining, containing twenty acres by computation be the same more or less, being the east side of a patent granted to James Hurst Senr. bearing deate the 23rd day of December 1763, togeather with all the previledges profits advantages or appurtenances whatsoever belonging or any wise appurtaining to the above premises. Likewise one other tract on the north sid of Goshen Swamp & on the east side of Cowhole Branch joining & between James Hurst Senr. & John Foley's line. Begining at a live oak at the run of Cowhole Branch, runing down the branch SO. 20 Et. 20 pole to a maple & poplar on John Foley's line, thence No. 48 Et. 110 pole to a hickory Foley's corner, then Et. 56 pole to a small white oak & black jack on Foley's other line, thence along his line So. 106 pole to a falling pine his corner, thence Wt. 23 pole to a pine John Shuffield's corner, thence to & aloong James Hurst senr. line So. 17 Wt. 96 pole to a live oak his corner, thence with his other line So. 55 Wt. 116 pole to the begining, containing forty acreds joining the above twenty acres & granted to the said James Hurst junr. patent bearing date the 10th day of November 1784, and with the above twenty acres conveyed to the said Levin Watkins his heirs & assigns forever. To have and to hold the above bargained premises, with all the appurtenances & previledges to the same belonging to him the said Levin Watkins his heirs & assigns forever, to his & their proper use benefit & behoofe forever, and the said Levin Watkins his heirs executors administrators & assigns shall and may from time to time & at all times hereafter by free virtue of these presents lawfully peacebly & quietly have hold occupie & enjoy the above bargained premises with all thing thereunto belonging freely & clearly acquitted from all manner of gifts grants bargains sales leases wills mortgages or intails or any other incumbrance whatsoever, the taxes that may hereafter become due only excepted & I the said James Hurst junr. my heirs and assigns do warrant & forever defend the above bargained premises to him the said Levin Watkins his heirs and assigns forever, from the lawfull claim of all manner of persons whatsoever. In witness whereof I have hereunto set my hand & seal this day & date above written. James Hurst Signed sealed & delivered in presence of Francis Oliver George Outlaw James Hurst State of No. Carolina Duplin County April Term 1787.
