James Heath To John Waters Deed 9 January 1787

(Transcribed by Joan S Dunn) Deed Book 1 A Page 478, 479, & 480 James Heath To John Waters Deed for 460 acres This indenture made the twenty ninth day of January in the year of our Lord one thousand seven hundred & eighty seven. Between James Heath of the State of North Carolina & County of Duplin of the one part, & John Waters of the same place of the other part. Witnesseth, that the said James Heath for divers good causes & considerations him thereunto moving, but more especially for the valuable consideration of the sum of one hundred & fifty five pounds current money to him in hand well & truly paid or secured to be paid by John Waters aforesaid before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath by these presents granted bargained sold assigned & set over to the said John Waters his heirs & assigns forever, the following tracts of land situate lying & being in the County of Duplin aforesaid on the west side of Maxwell Swamp & bounded as follows Viz. one tract patent by Isaac Parker of one hundred acres. Begining at a hickory oak on the side of Frank's Creek, runing thence So. 68 Wt. 126 pole to a black oak, thence No. 22 Wt. 126 pole to a lightwood stump, thence No. 68 Et. 126 pole to a pine, thence to the beg'g- also another tract of fifty acreds which was conveyed from Abraham Beesley to Alexd. Armstrong the eighth day of September 1776. Begining at the run of Jamey's Branch on the Beesley upper line & runs with the patent line No. 40 Et. to a pine the third corner of the paten, thence as the paten lines So. 50 Et. 127 poles to the loine of the other survey, thence as the line of that said survey No. 40 Et. to a red oak the second corner of the said land Beesley bought from James William, thence So. 50 Et. to the run of Maxwell swamp, thence down the run as it meanders to the mouth of Jamey's Branch, thence up the branch by various courses to the line of the new patent, thence up with the new patent to the begining, also one other tract of one hundred & ten acres, granted to Alexr. Armstrong the first day of April 1780. Begining at a red oak on the edge of Parker's Branch being the first station of one hundred acres patend by Isaac Parker, thence as that line So. 68 Wt. 126 pole to a red oak his corner, thence So. 35 Et. 116 pole to a black jack on Abraham Beesley's line, thence his line North 40 Et. 100 poles to a pine his corner, thence his other line So. 50 Et. 127 poles to a stake, thence No. 45 Et. 8 poles to a red oak, thence by Austin Beesley;s line No. 25 Wt. 56 pole to a pine, thence No. 84 poles to a white oak at the run of Armstrong's Branch, thence up the Branch untill opposite the begining, thence tot he first station, also one other tract of two hundred acres granted to Alexr. Armstrong the first day of April 1780. Begining at an ash at the run of Jameys Branch on Abraham Beesley's line & his own corner of another survey, thence his own line No. 25 Wt. 74 poles to a red oak his corner, thence his other line No. 28 Wt. 198 pole to a pine white oak & black jack his corner, thence his other line No. 67 Et. 66 poles to a poplar in Armstrong's Branch, thence the branch as it meanders with Williams's line 210 poles to a maple & gum, thence So. 200 poles to a pine,thence So. 80 Et. 80 pole to a water oak in Jamey's Branch, thence down the branch with Abraham Beesley's line to the begining, containing in the whole four pieces of land by estimation four hundred & sixty acres be the same more or less. To have & to hold the aforesaid land and premises with all the appurtenances to the same belonging or in any wise appertaining to him the said John Waters his heirs & assigns forever, free from all former gifts grants mortgages wills intails executions entents or troubles whatever committed or done by him the said James Heath, & the said James Heath the aforesaid land and premises shall & will warrant & forever defend to him the said John Waters his heirs & assigns from & against him the said James Heath his heirs & assigns, as also from & against the just & lawfull claim of all & every other person or persons whatever who may hereafter lay any lawfyll claim to the same. In witness whereof the said James Heath hath hereunto set his hand & seal the date above written. James Heath Signed sealed & delivered in the presence of Joseph Dickson Lewis Thomas State of No. Carolina Duplin County January Term 1788.
