Carter to Nicholas Sandlin Deed 100 Acres This indenture made the tenth day of September in the nineteenth year of American Independence and in the year of our Lord Christ 1794, Between James Gillespie of County of Duplin Esq. And Nicholas Sandlin of the same County planter and witnesseth that whereas the said James Gillespie was by Edward John James Agustus Carter late of this county in the state of the said Edward John James Agustus Carter nominated and appointed sale execution of his the said Johns last will and Testament leaving date the day of 1788 enters and on the execution of the same agreeable to law and that he the said James as executor aforesaid at divers times translated the business of his executorships until the whole of the personal property of the said Edward John James Agustus Carter has fully administered on said divers debts remaining unpaid and the said James Gilespie exec. As aforesaid having is not in his power to discharge the same deed at October Term in the said County of Duplin 1788 assign an order of the court of said County to sell 100 acres of land being the whole of the real estate the said deceased left at the time of his death which said order of sale was in the words following Duplin County October term 1788, James Gillespie Executor of Edward James John Agustus Carter deceased as there was no other property to discharge the debts of the said deceased it is therefore ordered that the said James Gillespie do sell the said 100 acres of land at six months ordered on security and make a proof thereof to next court Nov. knowing that I the said James Executor as aforesaid certified and disclosed to me did expose the said lands to sale after due notification by Joseph William deputed by the high Sheriff of Duplin and Daniel Southerland became the highest bidden consequently the purchaser of the said lands, at the sum of twenty seven pounds current money of N. Carolina, which sum I acknowledge to have received of do in within of the power granted to me by the will of the deceased of the aforesaid order of Court, I do hereby exonerate and acquit the said Daniel and his assigns from the same and he the said Daniel having sold the same to the said Nicholas Sandlin who is the possessor of the said lands and premises in consequence of his said purchase and is the same 100 acres patented by Henry Giliman and by him transferred to Aaron Hodges or and by him to the said Edward John James Agustus Carter reference being therefore had to the conveyance may more fully appear to have and to hold the said 100 acres of land to him the Nicholas Sandlin with all the appurtenances in as full and ample manner as he the said James could have held as devised the same by the powers granted by the will or the said order of Court and the said James Gillespie doth further covenant and agree to and with the said Nicholas Sandlin his heirs and assigns that he shall form time to time and at all times have hold use occupy and enjoy the said 100 acres of land free from the claim or demand of him the said James as exec. Or any person claiming by for as under him his heirs as assigns or either of them forever and the testimony whereof I have hereunto set my hand and seal the day and year first written seal and deliver.
