James Evans To George Mallard
Deed for 50 acres lands
This indenture made the first day of January in the ninth year of American Independence
and in the year of our Lord one thousand seven hundred and eighty five, between James Evans of
the State of No. Carolina and County of Duplin of the one part, and George Mallard of the same
place of the other part. Witnesseth, that the said James Evans for divers good causes and
considerations him thereunto moving, but more especially for the valluable consideration of
five pounds current money to him in hand well & truly paid or secured to be paid by George
Mallard aforesaid, before the ensealing and delivery of these presents, the receipt whereof is
hereby acknowledged, hath by these presents given granted bargained sold assigned and set over
to the said George Mallard his heirs and assigns forever, one certain piece or parcel of land
sittuate lying and being in Duplin County aforesaid on the west of the North East River, on both
side of Platts Branch a drean of horse branch. Begining at a pine Absalom Strickland's corner,
thence So. 60 Et. 60 pole to a large Pine by James Middleton's line, thence So. 65 Wt. 140 poles
to a poast or stake in a meadow at the head of the branch, thence So. 25 Wt. 52 poles to a water
oak, thence along Strickland's line to the first station, containing by survey fifty acres, be the same
more or less. To have and to hold the aforesaid land and premises with all the appurtenances to
the same belonging or in any wise appertaining of every nature or kind whatsoever, free from all
former gifts grants mortgages intails wills dowers right or title or dower executions entents or
troubles whatever committed or done by him the said James Evans or any other person or persons
whatever, by from or under him or them or any of them, and the said George Mallard the aforesaid
land and premises shall and may have hold use occupy enjoy and possess as his own free and
lawfull inheritance, free from all incumbrance whatever, the taxes as they become due only
excepted and the said James Evans the aforesaid land and premises to the said George Mallard
with all the appurtenances to the same belonging shall and will
warrent and forever derend from and against him the said James Evans his heirs and assigns as
also from and against the just and lawfull clame of all and every person or persons whatever
they may hereafter lay any lawfull clame to be the same. In witness whereof the said James
Evans hath hereunto set his hand and seal the date above written.
