(Transcribed by Joan S DUnn) Deed Book 12 Page 113, 114, & 115 Jacob J Johnston To Charity Deal & Elizabeth Thigpen Deed Gift for Land This Indenture made 20th day of July in the year of our Lord one Thousand Eight hundred & thirty nine between Jacob J. Johnston of the State of North Carolina and County of Duplin of the one part & Charity Deal & Elizabeth Thigpen one the Daughter of Barbary Deal & the other the Daughter of Hannah Thigpen these two girls I have raist of the other part witnesseth that first I except my lifetime and my wifes lifetime Elizabeth Johston our Lifetimes on the prmises to use as ours and after our death that I Jacob J Johnston as well for and in consideration of the Natural love and affection which I have and baredth unto the said Charity Deal & Elizabeth Thigpen as Also for the better maintainance and perferment of the said Charity Deal & Elizabeth THigpen hath given grante aliened enfeoffed and confrimed and by these presents doth give grant alien enfeoff and confirm unto the said Charity Deal & Elizabeth Thigpen all that messuage or tenement and so forth with all and singular its appurtenances and all out houses lands and the reversion and reversions remainder and remainders rents and services of the said premises and all the estate rite title interest property claim and demand whatsoever of him the said Jacob J Johnston of in and to the said Messuage or tenemant land and Premises and of in and to every part and parcil thereof with the appurtunances and all deeds evidinces and writing concerning the said premises onely now in the hands or custody of the said Jacob J Johnston or which he may get or come by without suit in law to have and to hold the said messuage or Tenement lands and premises hereby given and granted or mentioned or intended to be given and granted unto the said Charity Deal & Elizabeth Thigpen his heirs and assigns forever and the said Jacob J Johnston for himself his heirs Executors and Administrators doth covenant and grant to and with the said Charity Deal and Elizabeth Thigpen his Heirs and assigns by these presents that her said Charity Deal & Elizabeth Thigpen his heirs and assigns shall and may from henceforth forever hereafter peacibly and quietly have hold ocupy possess and enjoy the said Messuage tenement lands hereditaments and premises hereby given and granted or mentioned so to be with their appurtenances free clear and discharged of and from all former and other gifts grants bargains and sales feoffments Jointures dowers Estates entails rents rent charges arrages of rents and of and from all other titles troubles charges and incumbrances had made committed done or supposed by him the said Jacob J Johnston his heirs Executors Administrators or any other person Lawfull claiming or to claim by or under him them or any or either of them In witness whereunto I set my hand and seal in the presents of us the day & date first above written Jacob J Johnston Attest John J James Attest Bryant Marredey Atest F Pickett Attest Elijah Butler State of North Carolina Duplin County Court of please & Quarter Sessions October term 1839 The Execution of the within deed is duly proved in open Court by the oath of Bryan Merridy a subscribing witness thereto & is ordered to be registered Copy N Routledge Rgr Test James Dickson
