Hicks Mills To Benjamin Dulany Deed 20 March 1787

(Transcribed by Joan S Dunn) Deed Book 1 A Page 382, & 383 Hicks Mills To Benjamin Dulany Deed for 100 acres lands This indenture made the twentieth day of March in the eleventh year of American Independence & in the year of our Lord one thousand seven hundred & eighty seven. Between Hicks Mills of the State of No. Carolina & County of Duplin of the one part, & Benjamin Dulany of the same place of the other part. (Witnesseth) that the said Hicks Mills for divers good causes & considerations him thereunto moving, but more especially for the valluable consideration of the sum of fifty pounds specie to him in hand paid by Benjamin Dulany aforesaid before the ensealing & delivery of these presents, the receipt whereof he doth hereby acknowledge to be therewith fully satisfied contented & paid, hath by these presents given granted bargained sold assigned & set over to the said Benjamin Dulany his heirs and assigns forever, one certain tract or parcel of land, being part of three surveys, sittuated lying & being in Duplin County aforesaid, on the east side the No. Et. River & South side of Limestone Swamp, on the Et. Side of said Mills's Mill Branch. Begining at a black gum in said Mill Branch near his fence & thence So. 70 Wt. 127 poles crossing the main road to a small pine, thence So. 20 Wt. 127 pole to a stake, thence No. 70 Wt. 127 pole crossing the main road again to a gum & persimmon in the said Branch, thence down the run as it meanders to the begining, containing in the whole one hundred acres be the same more or less. To have & to hold the aforesaid land & premises with all the appurtenances to the same belonging or in any wise appertaining of every nature or kind whatsoever to him the said Benjamin Dulany his heirs & assigns forever, free from all former gifts mortgages intails dowers righty or title of dower or any other incumbrance whatever given granted or done by him the said Hicks Mills or any other person by from or under him, & the said Hicks Mills the aforesaid land & premises shall & will warrant & forever defend to him the said Benjm. Dulany his heirs & assigns forever, from & against him the said Hicks Mills his heirs & assigns as also from & against the just & lawfull clame of every other person or persons whatever who may hereafter lay any lawfull claim to the same, & the said Benjm. Dulany the aforesaid land & premises shall & may have hold use occupie enjoy & possess as his own free & lawfull inheritance, free from all incumbrance whatsoever, the taxes as they may hereafter become due only excepted. In witness whereof the said Hicks Mills hath hereunto set his hand & seal the date above written.
