(Transcribed by Joan S Dunn) Deed Book 12 Page 64, 65, & 66 H Hodges to the Heirs of W Hodges The State of Alabama Sumter County Know all men by these presents that Holloway Hodges of the State of North Carolina and County of Duplin for the love and affection I have for the Heirs of Wilson Hodges of the state of Alabama and County of Sumter doth this day give and bequeath unto the Heirs of said Wilson Hodges all and Singular the following property to have and to hold the same as their Lawful Right forever (vizt) Two yoke of oxen one ox waggon Four head of Horses nine feather Beds and three furniture Bed steads &c all the House hold kitchen Furniture two cows and calves four head of dry cattle the following Negroes (viz) one Negro man Tom aged about fifty five years Lewis aged about thirty five Patience aged about thirty Edmond aged about nine Nicia aged about thirty five Jane aged about six years Winna about nine years of age all and singular of which said premises are now in the possession of the said Wilson Hodges in the aforesaid County & state to have and to hold forever the above Stated property as their Lawful Right in Law and Equity in witness whereof I have hereunto set my hand and affixed my seal this the 19th day of June AD 1838 Hollaway Hodges Witness Present Test Robert Sikes L V Underwood The State of Alabama Sumter County Personally appeared before me Price Williams Clerk of the County court of said County Robert Sikes whose name appears to the forgoing deed as an attesting witness who after being first duly sworn deposetts and saith that Hollaway Hodges acknowledged as well in the presents of L V Underwood the other attesting witness as in the presence of this defendant that he signed sealed and delivered to forgoing Instrument the day of its date and for the purposes therein contained and this defendant further saith that he this defendant and said Underwood signed the same as sitnesses in the presence of each other In testimony whereof I hereunto subscribed my name this the Twelfth day of July AD 1838 Price Williams Clerk By James Kean DClk The State of Alabama Sumter County By virtue of the annixed commissions to us and Council R Wright directed personally came before us this the 13th day of March 1839 in the Town of Lexingston County of Sumter and State of Alabama at the office of Inging Smith Lancelott V Underwood who being first duly Sworn upon the Holy Evangilist of Almighty God depose and say that he Hollaway Hodges execute seal & deliver the forgoing deed for the purposes therein mentioned given under our hands and seals at Livingston this 13th day of March 1839 Robert H Smith Bennit Tompkins State of North Carolina Duplin County Court of please and Quarter Sessions July term 1839 It Appearing to the satisfaction of the Court that Robert Sykes & L V Underwood the subscirbing witnesses to the forgoing deed are not Residents of this State and the hand writing of Hollaway Hodges being duly proved by the oath of James K.
